RESOLUTION NO. 231 0'7
RESOLUTION ACCEPTING THE DEDICATION OF 1,224 SQUARE FEET, MORE OR
LESS (FOR EXISTING DRAINAGE CHANNEL) FROM MAYA Z. HAMBURGER,
TRUSTEE OF THE MAYA Z. HAMBURGER TRUST, STI'UATED AT PA`AU`AU,
DISTRICT OF KA'U, COUNTY AND STATE OF HAWAII, BEING A PORTION OF TAX
MAP KEY NO. (3) 9-6-022:045, TO THE COUNTY OF HAWAII.
WHEREAS, MAYA Z. HAMBURGER, TRUSTEE OF THE MAYA Z. HAMBURGER
TRUST dated August 25, 1991, as amended, is the owner of a pazcel containing an area of 1,224
square feet, more or less, located in Pa`au`au, County and State of Hawaii, specifically
identified as Tax Map Key No. (3) 9-6-022: portion of 045, and delineated on Exhibit "1"
attached thereto; and
WHEREAS, MAYA Z. HAMBURGER, TRUSTEE OF THE MAYA Z. HAMBURGER
TRUST dated August 25, 1991, as amended, is desirous of dedicating the subject pazcel,
including all improvements thereon, to the County of Hawaii for a drainage channel, which
parcel has been subdivided out in compliance with Chapter 23, Hawaii County Code as certified
by the Department of Public Works, Department of Water Supply and the Planning Department;
and
WHEREAS, the subject parcel and its improvements aze now serving as pazt of an
existing drainage channel providing runoff and flood control to portions of Pahala Village
Subdivision, 9`h Series, and its public roadways; and
WHEREAS, the County of Hawaii Department of Public Works is advised of the
proposed dedication, and has plans and funding for continuing and maintaining the said existing
drainage channel parcel in the public interest, and recommends acceptance of it; and
WHEREAS, the Article XIII, Section 13-12 of the Hawaii County Charter, provides that
the Council may accept gifts or donations of real property, on behalf of the County of Hawaii,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, that
the County of Hawaii accepts from MAYA Z. HAMBURGER, TRUSTEE OF THE MAYA Z.
HAMBURGER TRUST dated August 25, 1991, as amended, Lot 94-B, containing an area of
1,224 square feet, more or less, and all improvements on it, of the Pahala Village Subdivision, 9`n
Series, situate at Pa`au`au, in the District of Ka`u, County and State of Hawaii, identified as Tax
Map Key No. (3) 9-6-022: portion of 045, and delineated on Exhibit "1"attached hereto.
BE IT FURTHER RESOLVED that a letter of appreciation be sent to Maya Z.
Hamburger, Trustee of the Maya Z. Hamburger Trust dated August 25, 1991, as amended.

BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to (1) MAYA
Z. HAMBURGER, TRUSTEE OF THE MAYA Z. HAMBURGER TRUST dated August 25,
1991 as amended, 30924 Oceangrove Drive, Rancho Palos Verdes, California, 90275; (2) Mayor
Harry Kim, (3) Department of Public Works Bruce McClure; (4) Planning Director Chris Yuen;
and (5) Ivan M. Torigoe, Deputy Corporation Counsel.
