This is to acknowledge receipt of your letter dated May 10, 2007 requesting an
administrative 5-year time extension to comply with Condition C (Secure Final
Subdivision Approval) of Change of Zone Ordinance No. 97-101.
Condition L of Change of Zone Ordinance No. 97-101 allows for an initial administrative
time extension to comply with conditions that have lapsed. An initial s-year
administrative time extension to comply with Condition C was granted to the applicant
until July 14, 2007. Any additional time extension request for Condition C will need to
be brought before the Planning Commission and the Hawaii County Council for their
approval. You will need to submit your request, with reasons, along with 20 copies of
that request to the Planning Department with a $250 filing fee. The request will be
transmitted to the Planning Commission and the Hawaii County Council for appropriate
action.

Aloha Mr. Yuen:
Ordinance 97-101 became effective July 14, 1997. Condition C required Final
Subdivision Approval within five (5) yeazs from the effective date of said Ordinance, or
by July 14, 2002. By letter dated June 10, 2002, you confirmed the granting of a five (5)
year administrative time extension to Condition C, or until July 14, 2007.
By sending you this letter, I hereby respectfully request an additional five (5) year ~
administrative time extension to Condition C, or until July 14, 2012. The reason for this
request is that surviving co-owner Wayne Wilson, due to his financial and personal
situation, is unwilling and/or unable at this time to cooperate in my desire to obtain final
subdivision approval.
Please note that the existing improvements to this property are my personal residence and
Wayne Wilson's personal residence, and that no additional residences would be allowed
under the rezoning. If my request for an administrative time extension is not, or cannot
be approved, please advise ASAP. I will be receiving regular mail only until May 22,
2007 and after July 25, 2007 -but not in between those dates.
