I strongly request action' in the form of a complete investigation by your office into the
actions that have taken place with regards to the landfill cover Request for Bid number
1731. As the low bidder for this contract I fully expected to be awarded the contract for
services. I have instead been informed by telephone on Tuesday, December 30th, by
Bill Gray of the Finance Department that my bid proposal was being rejected because 1
did not follow the guidelines of the bid request. 14r. Gray stated in unspecific terms that
he looked up "organic" in the dictionary and found that any matter containing carbon
could be interpreted as being "organic". Since, in his belief my cover material, ash,
contains traces of carbon, I did not successfully meet the requirements as laid out in
the request for bid.
Let me •explain, Mr. Yagong, that I went through every procedure necessary in
determining that ash would be a good landfill cover. The material was tested by the
State Agriculture . Department, it was approved by John Harder of the State Health
Department and Office of Solid Waste Many _.ement, and was presented to Mayor
Stephen Yamashiro in a meeting a week before the bid opening. At no time did any of
my contacts question the appropriateness of u in; ash. In fact, all parties welcomed its
use as an innovative approach to the project.
I have since been congratulated by other unsuccessful bidders who have pledged their
support'for my bid. Only one bidder, Kiyosaki T re�:i.or Works, the current contractor and
husband of Chief Engineer Donna Kiyosaki, who was the second lowest bidder,
expressed any outrage at my proposal.
It seems to many involved in this matter, that eclair) the County of Hawaii isacting-in a
matter that totally disregards propriety. It is my fding that what has evolva ertsa'ply_�
needs to be investigated fully to determine hc;..w and why the decision to rikeicit mEi-bid: -,
was made and to ensure that my rights were no T`ceted in any way. —
