HUSSEY TAX MAP KEY: 5-9-007:007 I want to inform the Council that I mis-spoke to some extent on the subject of applying the new affordable housing standards of Chapter l 1, as amended February 2005, to zoning that needs a time extension. I had said that we have placed an affordable housing condition on time extensions since February 2005. Actually, the only situation that has previously occurred involving a new affordable housing condition is a bit different. Waikoloa Mauka had a zoning condition that had a required them to comply with Chapter 11, but they would not actually have had to provide affordable housing because the zoning involved one-acre lots, and the county at that time did not have an affordable housing requirement for one-acre lots. This was changed in the February 2005 amendments. When the time extension came in for Waikoloa Mauka, we made it clear that the new Chapter 11 requirements would now apply, which do create an affordable housing requirement. This is a bit different than what we recommended in the time extension for the subject rezoning. The original zoning did not have an affordable housing condition at all, because affordable housing was not required for three-acre lots, but we are recommending that it be added to the time extension. ~o. 3°~• 1 Hawaii County is an Equa! Honorable Pete Hoffinann Chair and Presiding Officer and Members of the County Council COUNTY COUNCIL Page 2 June 4, 2007 I do believe that adding in the affordable housing condition should be a standard practice and requirement when an applicant needs a time extension on the zoning ordinance. One of the reasons to have time conditions in the first place is to be able to review the zoning after some time has passed and the applicant has not finished the development of the property. It is a time when we can make sure that the applicant fulfills the same standards and expectations that we have of a new applicant. I do not believe that we have missed any time extensions since February 2005 when we should have added in the affordable housing condition.
