SUBJECT: Transmitting a Resolution Requesting the Planning Director to Initiate an Ordinance to
Amend Chapter 25, Hawaii County Code 1983 (2005 Edition, as amended) Relating
to Zoning
Enclosed is a proposed resolution requesting the planning director to initiate an ordinance to
amend Chapter 25, Hawaii County Code 1983 (2005 Edition, as amended) relating to zoning.
The resolution requests that Chapter 25, article 5, division 16, section 25-5-162(b), Hawaii
County Code 1983 (2005 Edition, as amended), be amended to permit wind energy facilities in
the Open zoned district, provided that a use permit is issued for each such use.
The requested proposed amendment to Chapter 25, article 5, division 16, section 25-5-162(b),
Hawaii County Code 1983 (2005 edition, as amended) would read as follows:
"(b) In addition to those uses permitted under subsection (a) above, the following uses
may be permitted in the O district, provided that a use permit is issued for each
use:
(1) Crematoriums.
(2) Golf courses.
(3) Wind energy facilities.
(4) Yacht harbors and boating facilities; provided that the use, in its entirety, is
compatible with the stated purpose of the O district."
The following is a red-lined version of the requested proposed amendment. The proposed new
language is underscored.
"(b) In addition to those uses permitted under subsection (a) above, the following uses
maybe permitted in the O district, provided that a use permit is issued for each
