Re: Acquisition of Kawa`a Bay, Hilea Nui
The Hawaii County Public Access, Open Space and Natural Resources Preservation
Commission cited Kawa'a Bay as a site where there are "Lands or property entitlements
with high public interest, imminent needs for acquisition, and largest benefit to the
general public". Resolution No. 451-06, passed by the County Council on
October 16, 2006, authorized the Director of Finance to enter into negotiations for the
acquisition of Tax Map Key parcels 9-5-017:007, 9-5-017:005, 9-5-016:025, and 9-5-
016:006, comprising approximately 785.161 acres of land collectively known as Kawa`a
and Kawa'a Bay, in the District of Ka'u. This was to be done in accordance with the
terms of Ordinance No. 05-166, as codified in chapter 2, article 42 of the Hawaii County
Code 1983 (2005 Edition, as amended), which established the Public Access, Open
Space, and Natural Resources Commission and Fund.
On that same day, the County of Hawaii, applied for funding by grant from the State of
Hawaii, Department of Land and Natural Resources, Legacy Land Conservation
Commission, for the acquisition of Kawa'a Bay. This application was prepared by
Council Member Bob Jacobson and his staff and submitted through the Managing
Director. On May 18, 2007, the Legacy Land Conservation Commission approved the
County's grant application and granted the amount of $1,214,750 to the County of
Hawaii. The approval of this grant to the County of Hawaii is scheduled to be heard
before the Board of Land and Natural Resources on June 8, 2007.
Enclosed is a resolution authorizing the Mayor to enter into an agreement with the State
of Hawaii Department of Land and Natural Resources, Legacy Land Conservation
Commission and to accept funds for the acquisition of Kawa'a Bay, HTlea Nui, Ka`u,
Hawaii.
In anticipation of getting the Board of Land and Natural Resources' approval and since
they must encumber these funds by appropriation on or before June 30, 2007, the
Department of Finance is requesting a waiver from the Finance Committee and have
this resolution heard at the next Council meeting scheduled for June 20t2«O~m7.No.~-r--

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Counci] of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
