SUBJECT: Transmitting Bill 106, Draft 2, Relating to Affordable Rental
Housing Classification
Attached please find a Draft 2 of Bill 106, relating to affordable rental housing classification.
This draft contains non-substantive "housekeeping" amendments made by the Finance
Committee during its May 31, 2007 meeting, at the suggestion of the Legislative Research
Branch. These amendments include the following:
1. In SECTION 2 of the bill, which amends section 19-2, Hawaii County Code, the numbers
preceding the definitions were removed. Further, in the definitions of "Commercial
agricultural use dedication" and "Nondedicated agricultural use assessment," designations
"(A)" through "(B)" were stricken and replaced with "(1)" through "(4)."
2. In SECTION 3 of the bill, amending section 19-53(e), Hawaii County Code, the word "is"
was removed from the first sentence of paragraph 19-53(e)(2)(B).
The affordable rental housing class is exclusively reserved for
properties which meet the eligible requirements for this class and have the
annual required application [isl timely filed."
(The change has been bolded and ramseyered for illustrative purposes only. )
3. In SECTION 3 of the bill, amending section 19-53(e), Hawaii County Code, the
words "Zoning Code" were changed to lower case in the last sentence of
paragraph 19-53(e)(2)(B)(iii).
