This draft contains the <br /> amendment to Draft 3 of this bill that was made by the Council, pursuant to communication no. <br /> 176.85, during its meeting on June 1, 2007. <br /> Specifically, the Council amended a paragraph that it had previously decided to add to <br /> subsection 27-18(c), Hawaii County Code. This new pazagraph, which will be placed at <br /> paragraph 27-18(c)(6), relates to standazds for construction within azeas of special flood hazards. <br /> As amended, this new pazagraph now reads as follows: <br /> "(6) Within areas where the grade of the natural elevation of the ground <br /> surface prior to construction exceeds ten percent, filling, grading and <br /> other development which may increase floodin>; or erosion hazazds shall <br /> be yrohibited unless a professional civil engineer licensed in the State of <br /> Hawaii certifies that the development will contain its own runoff and <br /> not increase flooding or erosion in other areas. Creation of impermeable <br /> surfaces on such sloping areas will be limited to no more than forty <br /> percent of the total land area of any lot or urotiosed new subdivision. <br /> Any measures to be implemented in order to prevent or decrease run-off <br /> or erosion shall be clearly shown or described on the grading or <br /> infrastructure construction plan." <br /> Thank you.
