This draft contains the amendment to Draft 3 of this bill that was made by the Council, pursuant to communication no. 176.85, during its meeting on June 1, 2007. Specifically, the Council amended a paragraph that it had previously decided to add to subsection 27-18(c), Hawaii County Code. This new pazagraph, which will be placed at paragraph 27-18(c)(6), relates to standazds for construction within azeas of special flood hazards. As amended, this new pazagraph now reads as follows: "(6) Within areas where the grade of the natural elevation of the ground surface prior to construction exceeds ten percent, filling, grading and other development which may increase floodin>; or erosion hazazds shall be yrohibited unless a professional civil engineer licensed in the State of Hawaii certifies that the development will contain its own runoff and not increase flooding or erosion in other areas. Creation of impermeable surfaces on such sloping areas will be limited to no more than forty percent of the total land area of any lot or urotiosed new subdivision. Any measures to be implemented in order to prevent or decrease run-off or erosion shall be clearly shown or described on the grading or infrastructure construction plan." Thank you. Ir Ref.
