SUBJECT: WAIAKEA CENTER -DEDICATION OF SEWER EXTENSION AND
REIMBURSEMENT FOR CONSTRUCTION COSTS
The Department of Public Works has several concerns regarding the request by Maryl
Development for Council approval of dedication and reimbursement for the Waiakea Center
sewer extension.
The letter requests reimbursement for all sewer revenues, including the Waiakea Center project
itself. We do not believe this is the intent of Hawaii County Code Section 21-28(a), which states,
"the applicant may receive for ten years after completion of the extension all moneys for sewer
charges collected by the County from other properties connecting to the extension."
We would also request [he opportunity to review costs which the developer is seeking
reimbursement for in order to confirm that all costs are directly associated with the extension.
Copies of all test reports, certifications, warranties, as-built drawings, and other pertinent
information associated with the extension should be submitted to our office.
