Dear Chairman Arakaki:
Re: Contract No. HA-98-1(N). Supplement No. 1, Agreement for Older
Americans Act Funds Between the Executive Office on Aging, State of
Hawaii and the County of Hawaii Through Its Office of Aeine
Attached is a resolution which authorizes the County to enter into supplemental
agreements for the above-referenced contract.
Please note that two additional grants have been added to the resolution because we have
been notified by the Executive Office of Aging, State of Hawaii, to anticipate a 10 percent
reduction in grant funding because of the State's current economic difficulties.
The supplemental contract, which is attached, increases the funding level of Contract
No. HA-98-1(N) from $701,761 to $725,812. Resolution No. 126-97 which authorized the
council chair to sign the original contract was adopted by the Council on August 20, 1997.
Please sign all three copies of the contract and route them back to Pauline Fukunaga of
this office. Thank you.

SUPPLEMENTAL AGREEMENT FOR HA-98-1-N
FOR OLDER AMERICANS ACT FUNDS
THIS AGREEMENT, effective the 12th day of December. 1997. is
entered into between the Executive Office on Aging, State of Hawaii (hereinafter "STATE"), by
its Director(hereinafter "DIRECTOR"), and the County of Hawaii. by and through its County
Council and its Mayor (hereinafter "CONTRACTOR"), whose business address is c/o Hawaii
County Office on Aging. 101 Aupuni Street. Room 342. Hilo. Hawaii 96720.

WHEREAS, by Contract No. HA-98-1-N, dated July 1, 1997,
(hereinafter referred to as "Primary Agreement"), Contractor agrees to use funds received under
this Agreement to provide the supportive social services, congregate and home delivered
nutrition, in-home services, and preventive health services programs and activities described in
the Executive Office on Aging approved Area Plan for the County of Hawaii; and
WHEREAS, the State and contractor mutually desire to modify, alter,
change, or extend the Primary Agreement in accordance with attachment 5 "General Conditions"
of the Primary Agreement;
NOW, THEREFORE, the State and contractor mutually agree that
Attachment 3, "Compensation and Payment Schedule" of the Primary Agreement, dated July 1,
1997, is hereby modified dated December 12, 1997 as attached. All other provisions of the
Primary Agreement shall remain in full force and effect.

Request for Payments (Area Agency Reporting Handbook), and are subject to the following
appropriate federal or State provisions:
c. Federal-Older Americans Act Funds
(1) If federal funds are awarded, the STATE shall use the allocation
plan contained on pages 4 ,5 and¢..of Attachment 3 as a basis of paying contractor, provided
that the STATE may reduce such said amount by any carryover funds that were previously paid
to Contractor and are still held by Contractor, upon submission by Contractor of written request
for payment.
(2) Program income, and interest or investment income, that is
collected or earned by Contractor as a result of activities supported by funds provided to
Contractor or any of its subcontractors under this Agreement shall be retained by Contractor or
its Subcontractors earning such income and shall be spent for the expanded level of services prior
to using funds provided under this Agreement.
(3) All payments shall be made in accordance with and subject to
Chapter 40, Hawaii Revised Statutes, which specifies the accounting procedures and controls
applicable to payments out of the Treasury of the State of Hawaii.
(d) State Funds
(1) If State funds are awarded, the State shall use the allocation plan
contained on pages Ih of Attachment 3, as a basis of paying Contractor, upon submission by
Contractor of written request for payment.
