Brilhante Request: ML-20 to MCX-20 Tax Map Key: 2-2-035-061 ANNUAL PROGRESS REPORT Dear Mr. Yuen: Per your letter of May 29, 2007, we humbly submit our progress report for this project. Section 2.A. The applicant fully intends to comply with all of the stated conditions of approval. Section 2.B. The applicant has paid the water commitment deposit of $150. (copy of receipt by Dept of Water Supply attached). Section 2.C. The applicant is making every effort to work within the time frames established in the ordinance. Development plans will address the proposed structure, fire protection measures, paved driveway accesses and parking stalls, landscaping and other improvements associated with the proposed use. Section 2.D. Applicant will comply in establishing a Waste Management Plan to be approved by the Dept. of Environmental Management. Section 2.E. The applicant has continuously maintained the property, poisoning and keeping the weeds down to a minimum to comply with the Dept. of Public Works request to minimize the amount of debris removal from the property. We are diligent in our efforts to keep the property maintained. Section 2.F. The applicant will comply with connecting to the existing sewer lateral along Kanoelehua Avenue. X29594 Section 2.G. The applicant will comply with the installation of a backflow preventer as required by the Dept of Water Supply. Section 2.H. Applicant will conform to the State Highways Division design standazds when working within the State highway Right-of--Way. Section 2.I. The applicant intends to fully comply with all applicable laws, rulels, regulations and requirements of the affected agencies involved. Section 2.J. The applicant constructed a retaining wall and graded the lot in preparation for future construction. The applicant has continuously maintained this property and continues to poison and keep the weeds to a minimum. The Dept. of Public Works requested that the amount of debris removal material be kept to a minimum so we are diligent in keeping on top of this. Section 2.K. The applicant will submit annual progress reports prior to the anniversazy date of the enactment of the ordinance for the Planning Department's review. Section 2.L. The applicant is making every effort to proceed with this project: An unanticipated delay has been caused by potential lenders in their reluctance to finance office building projects as they foresee a future overabundance of office spaces with the opening of the new Judiciary building. We aze working with lenders with whom we have solid track records and are confident we can obtain our financing soon. Mr. Yuen, at this time, we continue to work on our plans. We are very much wanting to proceed with this project. We thank you for your continued cooperation and assistance. For your information, we have also enclosed copies of our previous annual reports which were not as thorough as you require. We did diligently submit those reports in a timely manner, however we understand now your requirement for a more detailed report and we will comply with this format. Brilhante 1312 Kilauea Avenue Hiio, HI 96720 WATER COMMITMENT DEPOSIT FOR CHANGE OF ZONE APPLICATION (REZ 02-025) 1 ADDITIONAL UNIT OF WATER TAX MAP KEY 2-2-035:061 This is to acknowledge receipt of the required $150.00 water commitment deposit (WCD) for the subject application. Receipt No. 238239 is enclosed for your files. In accordance with the Department's "Rules and Regulations," a water commitment for the proposed development for one additional unit of water at an average day of 400 gallons per day or a maximum of 600 gallons per day, is hereby granted until November 30, 2006, with the following conditions: 1. Remittance of the prevailing facilities charge, which is subject to change, of $13,600.00 and is computed as follows: Facilities Charge: 1-inch Meter Connection (for 2 units of water at an average day of 800 gallons per day) $13,750.00 Credits: Total WCD paid to date -150.00 Facilities Charge Balance (Subject to Change) $13,600.00 2. Note that the amount of water commitment deposit may exceed the prevailing facilities charge amount; for example, when requests for time extensions continue and are approved. Until the development is finally completed, these are separate and unrelated items. In the event that water commitment deposits exceed the facilities chazge, no refunds are applicable. With this understanding, the current facilities charge balance is $13,600.00. This is due and payable upon completion of the construction of the necessary water system improvements. 3. Comply with all other applicable policies and requirements of the Department's Rules and Regulations.
