Brilhante Request: RS-10 to CG-20 Tax Map Key: 3/2-2-24:12 ANNUAL PROGRESS REPORT Dear Mr. Yuen: Per your letter of May 29, 2007, we hereby submit a progress report for this project. Section 2.A. The applicant fully intends to comply with all of the stated conditions of approval. Section 2.B. The applicant has paid the required $150.00 water commitment deposit. Copy of letter from the Dept. of Water Supply is attached. Section 2.C. Applicant will have a backflow preventer installed during construction of the project. Section 2.D. Applicant is attempting to comply in commencing with the t- i construction within the time frames ecified. Plans will include iden6 p Eying proposed structures, fire protection measures, paved driveway accesses and parking stalls and any other improvements associated with this project including landscaping. The property originally had a dwelling which sat vacant for many yeazs. The building was constantly being vandalized, becoming an eyesore and haven for the xP~ homeless. We received numerous complaints and concerns and filed reports on several occasions with the Police Department. 'l /r elJ'e7e). - The applicant hired a contractor to have the building demolished and all debris hauled away. (copy of demolition invoice attached) The applicant felt it was the best way to eliminate problems associated with an empty building. This property is no longer a detriment to the neighborhood. Also, to comply with the Dept. of Public Works concerns of keeping debris and green waste disposal to a minimum, the property is continuosly maintained to prevent weeds from growing. Section 2.E. Applicant will comply in submitting a Waste Management Plan. Section 2F. Applicant will delineate a 10-foot future road widening strip along Kilauea Avenue in the plans and understands no structural improvements shall be allowed within this road widening strip. Applicable setbacks will be taken from the 10- foot future road widening strip line. Section 2.G. Applicant will comply to have driveway connections to Kilauea Avenue conform to Chapter 22 of the Hawaii County Code. Section 2.H. The applicant will connect to the County sewer lateral within Kilauea Avenue. Section 2.I. The applicant will comply in keeping generated runoff disposed of on site and will not direct runoff toward any adjacent properties. Applicant will have a drainage study prepazed and submitted for review by the Dept. of Public Works. Section 2.J. The applicant fully intends to comply with all applicable rules, regulations and requirements of affected agencies. Section 2.K. The applicant will meet it's obligations for the requirements of the Unified Impact Fees Ordinance. Section 2.L. The applicant will comply in submitting detailed annual progress reports prior to the anniversary date of the enactment of the ordinance. Section 2.M. The applicant is making every attempt to keep within the timeframe and guidelines of the ordinance. The applicant has been delayed in obtaining suitable financing as many lenders are now reluctant to finance new office projects. With the expected opening of the new Judiciary building later in the yeaz, many office spaces currently occupied may soon be vacated causing lenders to be a little hesitant. We have a long-standing track record with a few lenders and will work diligently in getting financing secured for this project. If the applicant is unable to meet the construction deadlines set forth in the ordinance, a time extension will be humbly requested in within the guidelines set forth. r Mr. Yuen, it is our strong desire to move along with this project. We aze making every attempt to expedite this project and ask for your continued support and cooperation. For your information, we have also enclosed copies of our previous annual reports which were not as thorough as you require. We did diligently submit those reports in a timely manner, however we understand now your requirement for a more detailed report. Thank you for your attention to this matter. Receipt No. 238240 is enclosed for your tiles. In accordance with the Department's "Rules and Regulations," a water commitment for the proposed development for one additional unit of water at an average day of 400 gallons per day or a maximum of 600 gallons per day, is hereby granted until November 30, 2006, with the following conditions: I. Remittance of the prevailing facilities charge, which is subject to change, of $13,600.00 and is computed as follows: Facilities Charge: 1-inch Meter Connection (for 2 units of water at an average day of 800 gallons per day) $13,750.00 Credits: Total WCD paid to date -150.00 Facilities Charge Balance (Subject to Change) $13,600.00 2. Note that the amount of water commitment deposit may exceed the prevailing facilities charge amount; for example, when requests for time extensions continue and aze approved. Until the development is finally completed, these are separate and unrelated items. In the event that water commitment deposits exceed the facilities charge, no refunds are applicable.
