Suite C-5 Hilo, Hawaii 96720 Waimea, Hawaii 96743 r-.l o'.~ _ ~.l 1 C_ r- June 19, 2007 rv TO: Council Members ~ " Hawaii County Council FROM: Pete Hoffmann a Council Chairperson SUBJECT: Proposed bill for an ordinance to amend Chapter 5, Chapter 9, & Chapter 17 to exempt Habitat for Humanity Hilo and Habitat for Humanity Kona from the requirement to pay building, electrical, and plumbing permit fees, except for penalty fees when applicable Attached for your consideration is a proposed bill for an ordinance to amend Chapter 5, Chapter 9, and Chapter 17 of the Hawaii County Code 1983 (2005 edition), as amended, in order to exempt Habitat for Humanity Hilo and Habitat for Humanity Kona from the requirement to pay building, electrical, and plumbing permit fees, except for penalty fees when applicable. Habitat for Humanity Hilo and Habitat for Humanity Kona are Hawaii 501(c)(3) nonprofit corporations that work with economically disadvantaged people to provide affordable housing units in the County of Hawaii. The proposed fee exemptions for Habitat construction projects will reduce costs for the Habitat participants who will occupy these affordable homes. Penalty fees which may be assessed on Habitat projects are specifically excluded from the permit fee exemptions. First, a new subsection 5-1.0.12(d) of Chapter 5 (Building) is proposed to read as follows: "(d) [.7 Exemptions. The County, all agencies of the County, and contractors with the County, shall be exempt from the requirement of paying any permit fee. Habitat for Humanity Hilo and Habitat for Humanity Kona shall be exempt from the requirement of paving any permit fee. This exemption shall not apply to penalty fees when required under this chapter." Comm. No. Ref. To: ~ _ Ref. [E~euxty-exeePtien] Permit fee exemations. The County and all contractors performing work under authority of the County shall be exempt from the requirements to pay permit fees. Habitat for Humanity Hilo and Habitat for Humanity Kona shall be exempt from the requirement of paving any permit fee This exemption shall not apply to penalty fees when required under this chapter And third, a new subsection 17-28(d) of Chapter 17 (Plumbing), is proposed to read as follows: Habitat for Humanity Hilo and Habitat for Humanity Kona shall be exempt from the requirement of paving any permit fee except for fees imposed pursuant to subsection (bl when applicable This exemption shall not apply to penalty fees when required under this chapter.
