Re: Ordinance Amending Chapter 7, Hawaii County Code Relating to
Civil Defense Disaster Control.
Transmitted herewith for the approval of the Hawaii County Council is an ordinance to add a
mens rea, or state of mind, element of "knowingly" to sections 7-9 and 7-10 Hawaii County Code to be
in compliance with Hawaii Appellate Court ruling in State v. Keawemauhili, P.3d , 2007
WL 1028343 (Hawai`i App., 2007). State v. Keawemauhili, supra, requires that municipal ordinances
that are of a level of offense greater than a violation notice a specific state of mind or mens rea. Sections
7-9 and 7-10 Hawaii County Code are petty misdemeanors which are of a level of offense greater than a
violation. This bill further amends tidal wave to tsunami as a housekeeping measure.
