RESOLUTION NO. 252 07
RESOLUTION ACCEPTING THE GRANT OF EASEMENT FROM CLASSIC PACIFIC
KONA LLC TO REPAIR MAMALAHOA HIGHWAY IN HONOKbHAU 1ST, NORTH
KONA, HAWAII, DUE TO THE EARTHQUAKE OF OCTOBER 15, 2006.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, CLASSIC PACIFIC KONA LLC is the owner of Tax Map
Key: (3)7-4-006:012, situated Honokohau 1st, North Kona, Hawaii; and
WHEREAS, the County of Hawaii desires to repair Mamalahoa Highway in the vicinity
of Mile Post 8.9, within certain areas of Classic Pacific Kona LLC's property, due to the
earthquake of October 15, 2006; and
WHEREAS, Classic Pacific Kona LLC is desirous of granting the County of Hawaii a
perpetual nonexclusive easement, which easement is more particularly described in Exhibit A
and delineated on Exhibit B attached hereto; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the
Council, on behalf of the County of Hawaii, may accept gifts or donations of money, securities
or other personal property or of real estate or any interest in real estate.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that in accordance with Article XIII, Section 13-12 of the Hawaii County Charter,
the County of Hawaii accepts the grant of Easement A more particularly described in Exhibit A
and delineated on Exhibit B attached hereto, from Classic Pacific Kona LLC.

BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this
resolution to (1) the Mayor Harry Kim; (2) Bruce McClure, Director of Public Works; (3) Gerald
Takase, Assistant Corporation Counsel; and (4) Steven S.C. Lim, Esq., Carlsmith Ball,
121 Waianuenue Avenue, Hilo, Hawaii 96720, attorney for Classic Pacific Kona LLC.
