RESOLUTION NO. 253 0'7
RESOLUTION AUTHORIZING THE EXCHANGE OF REAL PROPERTY WITH
EDMUND D. BROUSSARD, RICHARD D. BROUSSARD, AND MORRIS BROUSSARD,
TAX MAP KEYS: (3)4-3-012:021 AND 022.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii is the owner of real property situate at Pa`auilo
Homesteads, in the District of Hamakua, Island and County of Hawaii, identified as Tank Site
No. 3, and bearing tax key designation 4-3-012:021 (highlighted in blue on the attached map);
and
WHEREAS, EDMUND D. BROUSSARD, RICHARD D. BROUSSARD, and MORRIS
BROUSSARD are the owners of real property situate at Pa`auilo Homesteads, in the District of
Hamakua, Island and County of Hawaii, identified as Tax Map Key: (3)4-3-012:022
(Lot 17-B-2-A-1 -outlined in yellow on the attached map); and
WHEREAS, the Department of Water Supply desires to exchange Tax Map
Key: (3)4-3-012:021 (the site of the existing tank and pump station) with Lot 17-B-2-A-2 (the
location of the new tank site -highlighted in green on the attached map); and
WHEREAS, the parcels are of equal size and shape; and
WHEREAS, EDMUND D. BROUSSARD, RICHARD D. BROUSSARD, and MORRIS
BROUSSARD have consented to the exchange; and

WHEREAS, on June 21, 2000, the consolidation of Lot 17-B-2-A and Tank Site No. 3
and resubdivision into Lots 17-B-2-A-1 and 17-B-2-A-2 (the location of the new tank site), was
approved by the Planning Department; and
WHEREAS, the two proposed new booster pumps on the new tank site will be enclosed
in a pipe and it is anticipated that it will run more silently than the existing one at Tank Site
No. 3; and
WHEREAS, the County of Hawaii also desires to transfer ownership of Lot 17-B-2-A-2
to the Water Board of the County of Hawaii; and
WHEREAS, Section 2-111, Hawaii County Code, permits the Council to dispose of real
property, Section 2-115, Hawaii County Code, allows for the exchange of County property for
private property, and Section 2-120 allows the disposition of real property to other governmental
agencies..
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, that in accordance with Sections 2-111 and 2-115, Hawaii County Code, the County
of Hawaii accepts the exchange of Lot 17-B-2-A-2, being a portion of Tax Map
Key: (3)4-3-012:022, from Edmund D. Broussard, Richard D. Broussard, and Morris Broussard,
in exchange for the remnant parcel being the old Tank Site No. 3, identified as Tax Map
Key: (3)4-3-012:021, and authorizes the transfer of Lot 17-B-2-A-2 to the Water Board of the
County of Hawaii.
BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this
resolution to (1) the Mayor Harry Kim; (2) Milton Pavao, Manager, Department of Water
Supply; (3) Gerald Takase, Assistant Corporation Counsel; and (4) Edmund D. Broussard,
Richard D. Broussard, and Morris Broussard, P.O. Box 434, Pa`auilo, Hawaii 9 6 7 7 6 .
