Re: Operating Budget
The State of Hawaii Legislature enacted Act 100, Session Laws of Hawaii 2006, which
amended the Homeless Assistance Act of the Hawaii Revised Statutes by adding a section on
temporary emergency housing. This amendment called for the State Administration to develop,
in consultation with the four counties, a procedure for identifying locations that shall be used for
temporary emergency shelters for homeless individuals, and that each county would be
responsible for partnering with nonprofit organizations to locate, designate, and maintain the
areas that shall be used for temporary emergency shelters. Pursuant to Act 100, the State
Legislature appropriated funds to assist the counties in implementing the amendment. As a
result, the Office of Housing and Community Development (OHCD) will be receiving $400,000 to
assist in the implementation of aforementioned amendment.
The County of Hawaii has proposed to use the funds to purchase and provide maintenance for
two houses in Hilo for shelter and services for the homeless, in partnership with the Office for
Social Ministry, a private nonprofit agency. The selected units are located in Hilo, at 189 Wilder
Road and at 1495 Kuleana Place. The Wilder housing unit underwent foreclosure in February
2007. To save critical housing inventory for homeless persons, the OHCD made efforts and
expended its funding to purchase the unit. The OHCD is now concerned that the Kuleana
housing unit may be in jeopardy. As such, the OHCD has worked with Corporation Counsel in
negotiating the sale of this unit before it too is subject to foreclosure.
Enclosed is a resolution to authorize the Mayor to enter into an agreement with the Hawaii
Public Housing Authority for the State funding.
Also enclosed is a bill for an ordinance amending the Operating Budget by appropriating the
$400,000 to the Homeless Transitional Housing Unit account within the County Housing
Revolving Fund.

Because of the urgency in saving these units from foreclosure and securing the funds, the
OHCD is requesting a waiver from the Finance Committee and have this resolution and bill
heard at the next Council meeting scheduled for July 25, 2007.

A. REQUEST:
The Office of Housing and Community Development (OHCD) requests:
(1) Council's approval authorizing the Mayor to enter into a Memorandum of Agreement with the State
Public Housing Authority for funds ($400,000) allocated through Act 100, Session Laws of Hawaii 2006.
Funds will be used to (1) purchase homeless transitional housing units located at 189 Wilder Road (Hilo) and
1495 Kuleana Place (Hilo) and (2) provide funding to the facilities' operator, Office for Social Ministry (OSM),
for the purchase materials needed to repair both facilities.
(2) Appropriation of the $400,000 into the County Housing Revolving Fund.
(3) Waiver from the Finance Committee.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Because of the East Hawaii Coalition for the Homeless's poor management of its homeless programs, the
Wilder housing unit underwent forclosure. To save critical housing inventory for homeless persons, the
OHCD made efforts and expended its funding to purchase the unit. As the EHCH utilized funding through
the HOME Investment Partnership (HOME) to purchase both units, the OHCD was also able to avoid a
repayment of the funds to the U.S. Department of Housing and Urban Development.
The OHCD is now concerned that the Kuleana housing unit may be in jeopardy. As such, the OHCD has
worked with its Corporation Counsel in negotiating the sale of this unit before it too is subject to foreclosure.
During the effort to acquire the Wilder housing unit, the OHCD worked with the State's HPHA and Budget &
Finance to execute the MOA, which would allow the County to be reimbursed for expenses incurred from the
purchase of the Wilder housing unit, and the likely subsequent purchase of the Kuleana housing unit.
Because of the urgency in saving these units from foreclosure and securing the funds through the MOA, the
OHCD requests the waiver of Finance Committee review. In addition, with needed repair to both facilities,
the OHCD wishes to provide funding to the OSM. As the newly selected operators for these programs, the
OSM has secured donated labor to complete the repairs.

RE: Resolution No. 267-07 :Resolution authorizing the office of the Mayor to
enter into an agreement with the Hawaii Public Housing Authority, pursuant to HRS 46-
7, for the County of Hawai`i's Homeless transitional housing units, and
RE: Bill No. 133 : An Ordinance to amend ordinance no. 07-82, as amended, the
operating budget for the county of Hawaii for the fiscal year ending June 30, 2008.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that both of the above-referenced
matter be waived from the Finance Committee to the full Council for immediate action. In
reviewing this matter, timely approval is crucial It is therefore advantageous that approval is
granted and the matter placed onto the next Council agenda for review. However, in the event
this request is denied, for whatever reason, I understand the matter shall be referred to the
Finance Com ittee for placement on its future agenda.
