RE: Proposed Amendments to Bi1182, Draft 2 (Relating to an Ordinance Amending
Ordinance No. 02 21, which Amended Ordinance No. 98-87, which Amended
Ordinance No. 90-008, and which Reclassified Lands From Agricultural - 20
Acre (A-20a) to Agricultural - 3 Acre (A-3a) at Kahua 151, North Kohala,
Hawaii, Covered by Tax Map Key 5-9-007:007.)
Applicant: Elwin F. Hussey
This communication transmits proposed amendments to Bi1182, Draft 2 that suggest the
correction of various non-substantive typographical and grammatical errors contained in Bi1182,
Draft 2. The proposed amendments being suggested are:
1. The title of the Ordinance is amended by adding a hyphen in the reference to Ordinance
No. 02 21 and an okina inserted in the word "Hawaii" at the end of line 4, as follows:
"AN ORDINANCE AMENDING ORDINANCE NO. [9~)-] 0221, WHICH
AMENDED ORDINANCE NO. 98-87, WHICH AMENDED ORDINANCE NO.90-
008, AND WHICH RECLASSIFIED LANDS FROM AGRICULTURAL - 20 ACRE
(A-20a) TO AGRICULTURAL -3 ACRE (A-3a) AT KAHUA 1 sT, NORTH KOHALA,

2. An okina is inserted in the word "Hawai`i" in the "Be It Ordained" line as follows:

3. In SECTION 1, a hyphen is added to the Ordinance number, as follows:

4. In Condition "B," the word "requirement" is changed to plural and an okina inserted in
the word "Hawai`i" online 2, as follows:
"B. The applicant, successors or assigns shall be responsible for complying with all
[iegxiretnent] requirements of Chapter 205, [I-Iewei~i] Hawaii Revised Statutes,
relating to permissible uses within the State Land Use Agricultural District;"
5. In Condition "G," the period at the end of the paragraph is changed to asemi-colon, as
follows:
"G. A drainage system shall be installed in accordance with the requirements of the
Department of Public Works[:];"
6. In Condition "M," the word "and," at the end of the paragraph is deleted, as follows:
"M. An annual progress report shall be submitted to the Planning Director prior to the
anniversazy date of the effective date of the zone change. The report shall address
the status of the development and the compliance with the conditions of approval.
This condition shall remain in effect until all of the conditions of approval have
been complied with and the Planning Director acknowledges that further reports
aze not required; [ate]"
7. In Condition "N," the period at the end of the sentence is deleted and asemi-colon and
the word "and" substituted in its place, as follows:
"N. If the applicant should require an additional extension of time, the applicant shall
submit its request to the Hawaii County Council for appropriate action[:]"
8. In Condition "O," the word "it" contained towards the end of the second line is changed
to "its," as follows:
"O. Further, should any of the conditions not be met or substantially complied with in
a timely fashion, the Director shall initiate rezoning of the azea to [it] its original
or more appropriate designation."
