Statement in Opposition w Bill 112
Dear Chairman 1-loftmritt and Members of the Council:
I am testifying in opposition to Bill 112. I am a fourth generation kat»aaina family which has
resided iu Kona since the late 1800'x. i have 4 children, which 1 hope will reside in Kona, for
another generation and so on.
Through hard work 1 have purchased a property on which 1 now rncida with my family that Was
previously zoned property, Given my career path of real estate 1 purchased with reliance attd
checked with county abc`ncies as to the zoning and possibility for subdivision with the intent to
subdivide and provide land for tature generations. 1'hrouplt my purchase I'.net my neighbors the
Miyose fnnily who have been on their lands for nearly 100 years. They have 3 daughters and we
found that the common goal to pa5c nn tam ily lands was something that wt: both shared. 'T'heir
land was also previously zoned..
Bill 112 threatens local families being able to subdivided lands for family needs end burdens d,c
very families that are trying to provide land for futw•e generations by also requiring that family to
satisfy the hooting nv~ds of others. Hill 112 will add hundreds of thousands of dollars and will
render local families unable to fulfil] n;quirements and wilt eventually lead. them to sell to
developers that have the ability to pay the expenses. l'm sure it is not this council's intention tU
displace local families.
I have been provided a copy of artnrney Michael .f. Mxtsukawa's written testimony provided tC
this council for consideration-1 find his testimony to be on point and Support the following:
1. Defer action Bill 112
2. Finish the Comrnunity Development Flan which was manrtarPd by the General Plano[
which many of the current council members passed into law. Hurnireds or maybe
thousands of hours have been spent on the Community Development Plan with input
from the community, developers, and professional consultants.

3. Adopt a regionally directed and regionally administered Community Development Platt
that is intcndcd lu addiess housing Heads through various `smart growth" techniques
4. Have an ovinion by corporation counsel as to whether this proposed change to Chapter 11
which has been traditionally applied at the zoning level be subject':o challenge by
Ittndowners of previously zoned sub-dividaUle lands which has tractiricnally bccn u
ministcrinl process.
