Mahuna, dated May 31, 2007, transmitting the above report of mission conducted on May 19, 2007 in East Hawaii. The report indicates the number of plants eradicated. Comm. 507: ORDINANCE AMENDING CHAPTER 7 OF THE HAWAII COUNTY CODE 1983 (Bill 124) (2005 EDITION, AS AMENDED), CIVIL DEFENSE, RELATING TO LOITERING (adds a mens rea, or state of mind, element or "knowingly" to sections 7-9 and 7-10 to be in compliance with Hawaii Appellate Court ruling; and replaces all occurrences of the words tidal wave with tsunami) From Deputy Corporation Counsel Craig Masuda, dated June 4, 2007, transmitting the above bill. States that due to the Hawaii Appellate Court ruling, State v. Keawemauhili, municipal ordinances that are of a level of offense greater than a violation notice a specific state of mind or mens rea. Sections 7-9 and 7-10 Hawaii County Code are petty misdemeanors which are of a level of offense greater than a violation. This bill further amends tidal wave to tsunami as a housekeeping measure.
