Your Committee on Public Safety and Parks and Recreation, to which was referred Bill No. 124,
reports as follows:
Bill No. 124, transmitted by Deputy Corporation Counsel Craig Masuda via Communication
No. 507, dated June 4, 2007, amends Chapter 7 of the Hawaii County Code 1983 (2005 edition,
as amended), relating to Civil Defense.
The purpose of this ordinance is to bring Sections 7-9 and 7-10 of the Hawaii County Code
into compliance with a recent Hawaii Appellate Court ruling, State v. Keawemauhili, 2007
WL 1028343, which requires that a specific mens rea, or state of mind, element of "knowingly"
be stated for county ordinances where violations are punished as petty misdemeanors or higher.
This bill also replaces all occun•ences of the words tidal wave to tsunami as a housekeeping
measure.
There was no discussion on this measure.
Your Committee on Public Safety and Parks and Recreation is in accord with the purpose and
intent of Bill No. 124 and recommends it pass first reading.
