Re: Ordinance No. l92 (Draft 2~
Pursuant to Hawaii County Charter (1991), Section 3-12 , I am disapproving Bill 192 relating to
the restriction of peddling at the Waipio Valley lookout area.
The language currently reads "Old Honokaa-Waipio Road, from its northern end of State
Highway (FAS 240) on the Waipio Valley side ofKukuihaele Village to the Waipio Valley Lookout."
The word "its" modifies Old Honokaa-Waipio Road, which makes it ambiguous and therefore
unenforceable.
The language should be modified to:
"Old Honokaa-Waipio Road, from 'the' northern end of State Highway (FAS 240) on the
Waipio Valley side ofKukuihaele Village to and including the Waipio Valley Lookout
area."
or
"Old Honokaa-Waipio Road, from its intersection' with the northern end of State
Highway (FAS 240) on the Waipio Valley side of Kukuihaele Village to and including
the Waipio Valley Lookout area."
With either of these changes, the ambiguity would be removed and an enforceable ban could
them be executed by the police department.
