Your Committee on Planning, to which was referred Bill No. 113, reports as follows:
Bill No. 113, transmitted via Communication No. 481 from Mayor Harry Kim, dated June 6, 2007,
presents an amendment to Change of Zone Ordinance No. OS-157 (Conditions "B", "C" and "I") by
WAIKOLOA MAUKA, LLC, which rezoned approximately 761 acres from Agricultural 5-acre
(formerly Unplanned) and Multiple-Family Residential 1,500 squaze feet (RM-1.5) districts to a
Residential and Agricultural 1 acre (RA-la) and Open (O) districts.
The property, referred to as the proposed Waikoloa Highlands Subdivision, is located along the south
side of Waikoloa Road and south/southeast of Waikoloa Village, Waikoloa, South Kohala, Hawaii,
TMK: 6-8-2: portion of 16 and TMK: 6-8-3: portion of 32.
Applicant is requesting amendments to Condition "B" (Subdivision Approval), Condition "C"
(Access) and Condition "I" (Fair Share Contribution) of Ordinance No. OS-157. Conditions "B" and
"C" relate to the nature or roadway improvements at the intersection of Paniolo Avenue/Pua Melia
Street and Waikoloa Road, as well as a number of accesses to Waikoloa Road. Condition "I" relates to
impact fees (Fair Share Contribution) and applicant is requesting to expand Condition "I" to allow
consideration for amulti-use community center.
The Planning Commission concurred with the Planning Director's reasons for recommending
favorable consideration of the proposed amendments. Communication 481 transmits the following
findings and recommendations:
Condition "B" requires signalization improvements at the intersection of Waikoloa Road with Pua
Melia Street/Paniolo Avenue. However, following discussions with various individuals, applicant
states a "roundabout" instead of a signalized intersection may be more appropriate and although on-site
infrastructural plans have been completed, the signalized plans have been suspended pending decision
on the type of improvements required.
Condition "C" limits access only along Waikoloa Road at the makai end of the project and another
access is planned at Pua Melia Street. Both accesses would only serve the lower portion of the project,
and to address mauka area residents exiting the subdivision in the event of an emergency, applicant is
proposing two roadways from the project site.

Condition "I" relates to impact fees (Fair Share Contribution) and applicant is requesting that
Condition "I" also allow consideration for amulti-use community center since discussions with the
community have identified a need for amulti-use community center.
The Planning Director recommended favorably on this request based on the following:
• The non-performance is the result of conditions that could not have been foreseen or are
beyond the control of the applicant, successors or assigns, and are not the result of their fault or
negligence.
• Granting of the time extension would not be contrary to the General Plan or the Zoning Code.
• Granting of the time extension would not be contrary to the original reasons for the granting of
the change of zone.
The Planning Director also stated that in addition to amending Conditions "B", "C" and "I" as above
noted, he recommends that existing Conditions of Approval be revised to reflect the current standard
language for Conditions of Approval.
At the July 9, 2007 Planning Committee meeting Council Chair, Pete Hoffmann, expressed concerns in
regards to the water service and the solid wastewater management plan that were not included as part
of the conditions for approval. Mr. Hoffmann informed your Committee that he will be meeting with
Mr. Chris Yuen, Planning Director and Mr. Sidney Fuke, Consultant for the developer, on these
matters, and will provide the information to the Council.
Your Committee on Planning is in accord with the purpose and intent of Bill No. 113, and
recommends it pass first reading.
