The Planning Commission, after a duly held public hearing on July 6, 2007, voted to recommend
for your approval the proposed legislative bill for a change of zone from a Single Family
Residential - 10,000 squaze feet (RS-10) to anIndustrial-Commercial Mixed - 20,000 squaze
feet (MCX-20) district for 22,500 square feet of land. The property is located on the northwest
side of the Lanikaula Street-Hinano Street intersection, Waiakea Houselots 15` Series, Waiakea,
South Hilo, Hawaii.
The Commission concurs with the following Planning Director's reasons for recommending
favorable consideration of the change of zone:
The applicant is requesting a Change of Zone from Single-Family Residential
10,000 square feet (RS-10) to Industrial-Commercial Mixed 20,000 square feet (MCX-
20) for 22,500 squaze feet of land. The applicant is proposing to construct a 6,250-squaze
foot steel framed building, which will be used as a self storage business with an office.

In order to consider an area for any type of zoning designation, the applicable
goals, policies and standazds of the General Plan must be adequately addressed. It is only
through such a comprehensive policy analysis approach that evaluations and decisions
can be made to better time and stage developments to achieve growth determined by the
General Plan and related planning documents. The implications of these evaluations and
decisions must also be considered as they may have an impact on similaz azeas in the
County.
The Change of Zone request from Single-Family Residential 10,000 squaze feet
(RS-10) to Industrial-Commercial Mixed 20,000 square feet (MCX-20) will conform to
the goals, policies and standazds of the General Plan Economic and Land Use Elements.
The General Plan is intended to be used as a policy guide for the coordinated growth and
development of all sectors of the County. It sets forth goals, policies, standards and
courses of action to accommodate growth without congestion, to designate and preserve
the lands needed for residential use, commercial and visitor services, industry, agriculture
and open space, and to coordinate these uses with the County's service and circulation
systems. The overall goals, policies and standazds are set forth to physically plan the
lands in the County in the best interest of the island's residents. Land Use is one of the
principal focal points of public concern and policy. The Land Use Element provides the
primary basis for direct control and guidance of publicly and privately owned resources.
The request conforms to the goals, policies and standards of the General Plan in
that the proposed development will be developed in an area adequately served by
necessary services such as water, utilities, sewers and transportation systems. The
proposed project also conforms to the Land Use -Industrial sub-element which states that
"Industrial development shall be located in areas adequately served by transportation,
utilities and other amenities."
The Land Use Pattern Allocation Guide (LUPAG) Map component of the General
Plan is a representation of the document's goals and policies to guide the coordinated
growth and development of the County. It reflects a graphic depiction of the physical
relationship among the various land uses. The LUPAG Map establishes the basic urban
and non-urban form for areas within the County. The project azea is designated Industrial
on the LUPAG Map. This industrial designation includes uses such as manufacturing and
processing, wholesaling, large storage and transportation facilities and light industrial
uses. The MCX zoning would be consistent with the Industrial designation on the
LUPAG Map for this area of Hilo.

The State Land Use designation for the subject property is Urban. The Hilo
Community Development Plan (CDP) adopted in 1975 suggests the retention of
residential uses in this azea. However, this azea is transitioning to commercial and light
industrial uses. The advantage of this azea is its location in close proximity to water, air
transportation terminals, hazbor facilities and the residential population of Hilo. The
proposed change of zone would complement the existing industrial and commercial land
uses that already exist in this azea and will provide for an orderly development of the
area.
The MCX zoning designation was created when the Zoning Code was amended in
1996. In accordance with Section 25-5-130, Hawaii County Zoning Code, this district
would allow a mix of light industrial and commercial uses. The intent is to provide for
azeas of diversified businesses and employment opportunities by permitting a broad range
of uses, without exposing non-industrial uses to unsafe and unhealthy environments.
The property is 22,500 square feet in size and is rectangular in shape. It is located
on the northwest comer of Lanikaula Street and Hinano Street. The applicant is proposing
to relocate her current storage business to the new facility, which will be a 6,250-squaze
foot steel framed building for self storage and an office.
The land uses in the immediate area aze a mix of residential, commercial, and
industrial uses. Industrial-commercial uses to the east include a small shopping complex
on the corner of Lanikaula Street and Laukapu Street zoned ML-20 by Ordinance No. 94
5 (REZ No. 757). Businesses in the shopping complex include Sputnik's, Affordable
Catering, Punahele Bake Shop, and Dino's Fish and Tackle, among others. Across the
shopping complex aze two parcels recently zoned to MCX-20 by Ordinance No. 06-146
(REZ No. 06-000043), which will be used as office and storage space for an engineering
firm. To the south on Hinano Street is a carpet business and an electrical business on
properties zoned ML-10. To the west on the corner of Lanikaula and Manono Street is a
property zoned ML-20. This property consists of businesses such as Hawaii Fazm
Services, Mid Pacific Wheels, Doc Stanley's Repair, Hawaiian Island Glass Tinting and
Auto Shine, which are within a wazehouse structure. To the north on Hinano Street are
single family dwellings. Immediately adjacent properties are zoned RS-10 and consist of
single-family residential uses.
All utilities and services aze available to the site. Access to the project site will be
from Lanikaula Street, which is a County roadway with an approximate pavement width
of 22-24 feet within a 50-foot right-of way. On-site paved parking will be available. As
part of the rezoning approval, the property will be required to set aside a 5-foot future
road widening strip along Lanikaula Street and Hinano Street, and provide a 20-foot

corner radius at the intersection. Additionally, the applicant will be required to provide
improvements to the entire frontage along Lanikaula Street and Hinano Street, consisting
of, but not limited to, pavement widening with concrete curb, gutter and sidewalk,
drainage improvements, and any required utility relocation. County water is available to
the site. The project will connect to the County sewer system. Solid waste will be
handled by commercial haulers. Electricity and telephone services are available to the
site.
The property has no severe geological or topographical problems which cannot be
rectified or which would render the land unusable. The project site is located within Zone
"X", area determined to be outside the 500-year floodplain. All development generated
storm run-off shall be disposed of on-site and not allowed onto adjacent properties or
roadways.
The subject request is not contrary to Chapter 205A, Hawaii Revised Statues,
relating to Coastal Zone Management. The project site is not located in the Special
Management Area. The property is located approximately two miles from the shoreline
and will not be impacted by coastal hazard and beach erosion. There is no record of a
designated public access to the shoreline or mountain azeas that traverses the property.
No valued cultural, historical or natural resources exist on the property and there is no
evidence of any traditional and customary Native Hawaiian rights being practiced on the
site. Thus, it is not anticipated that the proposed request will have any adverse impact on
cultural or historical resources in the area. Therefore, no action is necessary to protect
these rights.
Based on the above findings, approval of this change of zone request from
Single-Family Residential 10,000 squaze feet (RS-10) to Industrial-Commercial Mixed
20,000 square feet (MCX-20) would result in an appropriate land use pattern that will
further benefit the general public.
For your favorable consideration, an amendment to Section 25-8-33 (City of Hilo Zone Map), of
the County Zoning Code is transmitted.

CYNTHIA KUULEI THOMAS has submitted an application for a Change of Zone
from Single-Family Residential 10,000 square feet (RS-10) to Industrial-Commercial Mixed
20,000 square feet (MCX-20) for 22,500 square feet of land. The property is located on the
northwest corner of the Lanikaula Street and Hinano Street intersection, Waiakea Houselots ls`

PROPOSED ACTION
1. Request: The applicant is requesting a Change of Zone from Single-Family Residential
10,000 square feet (RS-10) to Industrial-Commercial Mixed 20,000 square feet (NICX-
20) for 22,500 square feet of land. The applicant is proposing to construct a 6,250-square
foot steel framed building, which will be used as a self storage business with an office.
2. Reasons For Request: The applicant is proposing to relocate her current storage
business called A & A Storage Company located in Keaukaha to the new facility.
3. Projected Timeframe and Cost: The estimated timeframe to construct the
improvements will take approximately 18 months to complete. The estimated cost of
improvements is $350,000.
4. Employees and Clientele: Only one employee is needed to operate the business. It is
estimated that the storage business will service about 150 customers.
5. Hours of Operation: 9:00 a.m. to 5:00 p.m., Monday to Friday, and 9:00 a.m. to 12:00
noon, Saturday and Sunday.
6. Supportive Information: The applicant, who is the landowner, has submitted the

10. Proposed MCX Zoning: The purpose of the MCX (industrial-commercial mixed use)
district is to allow mixing of some industrial uses with commercial uses. The intent of
this district is to provide for areas of diversified businesses and employment opportunities
by permitting a broad range of uses, without exposing non-industrial uses to unsafe and
unhealthy environments. This district is intended to promote and maintain a viable mix
of light industrial and commercial uses.
• Height limit - 45 feet.
• Minimum yards -front yards 20 feet, side and rear yards, none, except where the
adjoining building site is in a RS, RD, RM or RCX zoned district. Where the side or
rear property line adjoins the side or rear yard of a building site in a RS, RD, RM or
RCX zoned district, side or rear yard must conform to the side or rear yard
requirements for dwelling use of the adjoining district.
11. Hilo Community Development Plan: The Hilo Community Development Plan adopted
by Planning Commission Resolution No. 1 on May 21, 1975 designates the area as RS-
10.
12. Chapter 205A, HRS, Coastal Zone Management Program: The entire State of
Hawaii lies within the Coastal Zone Management area. The intent of the Coastal Zone
Management Program is to guide and regulate public and private uses in the coastal zone
management area with respect to recreational resources, historic resources, public access
to the shoreline, scenic and open space resources, coastal ecosystems, marine resources,
economic uses, coastal hazards, managing development, public participation, and beach
protection.
13. Special Management Area: The property is not situated within the County's Special
Management Area and is located approximately 2 miles from the nearest coastline.
DESCRIPTION OF PROJECT SITE AND SURROUNDING AREA
14. Subject Property: The property is 22,500 squaze feet in size and is rectangular in shape.
Currently, there are several storage containers located on-site. According to the
applicant, the property was used as a residence for nearly 85 years.
15. Surrounding Zoning and Land Uses: The land uses in the immediate azea are a mix of

residential, commercial, and industrial uses. Industrial-commercial uses to the east
include a small shopping complex on the comer of Lanikaula Street and Laukapu Street
zoned ML-20 by Ordinance No. 94 5 (REZ No. 757). Businesses in the shopping

To the north on Hinano Street are single family dwellings. Immediately adjacent
properties are zoned RS-10 and consist ofsingle-family residential uses.
16. U.S.D.A. Soil Type: Papai extremely stony muck, 3 to 25 percent slopes (rPAE). The
Papai Series consists of well drained, thin, extremely stony organic soils fragmental Aa
lava.
17. Land Study Bureau's Detailed Land Classification System: Existing urban
development.
18. Agricultural Lands of Importance to the State of Hawaii (ALISH) Map: Existing
urban development
19. Noise Impacts: Existing ambient noise includes vehicular traffic in the project area.
Short-term noise impacts associated with the project will be temporary with compliance
to all applicable State rules governing construction noise abatement.
20. Air Quality: The proposed project should not directly impact air quality in the area.
Fugitive dust during construction can be mitigated by compliance with the Department of
Health's regulations. The only impact to air quality would be associated with vehicular
traffic to and from the site.
21. FIRM: Zone "X", an area outside of the 500-year flood plain.
22. Flora/Fauna: No professional surveys were conducted of the site. The applicant states,
"as the site has been disturbed, it is very unlikely that the site would currently serve as a

habitat for rare or endangered animal species."
23. ArchaeologicaUHistorical Resources: According to the applicant, the site has been
previously disturbed and it is very unlikely surface and subsurface remains would be
found on the site. The applicant has sent a letter dated February 21,2007 to the
Department of Land and Natural Resources-State Historic Preservation Division
requesting fora "no-effect" determination letter be issued for the request. As of the date
of this writing, there has been no reply to this request.
24. Cultural or Native Gathering Rights: There is no evidence of any traditional and
customazy Native Hawaiian rights being practiced on the site, nor existence of any known
valued cultural, historical or native resources in the area.
25. Traffic: The applicant states that the traffic impact should be minimal, as the average
daily customer visits are between two to ten customers per day and not at the same time.
26. Public Access: There is no record of a designated public access to the shoreline or
mountain areas that traverses the property.
PUBLIC UTILITIES AND SERVICES
27. Access: Access to the project site is proposed from Lanikaula Street. Lanikaula Street is
a County roadway with an approximate pavement width of 22-24 feet within a 50-foot
right-of way. Hinano Street is a County roadway with an approximate 18-foot pavement
width within a 40-foot right-of--way.
28. Water: County water is available to the site.
29. Wastewater: County sewer is available to the site.
30. Solid Waste: Solid waste will be handled by commercial haulers.

A. SUBTECT REOUEST
Cynthia Kuulei Thomas is requesting a Change of Zone, by changing the district
classification from Single Family Residential [RS10] to MCX Industrial Commercial
Mixed District for approximately 22,500 square feet of land. The property is located at
the Northwest comer of the Lanikaula Street - Hinano Street intersection: Waiakea
House Lots, South Hilo, Hawaii. TMK: (3) 2-2-36-90.

1~ DETAILS OF PROPOSED USE
The applicant is requesting a change of zone to allow mixed use industrial commercial
on the subject property: 383 East Lanikaula Street; TMK (3) 2-2-36-90. Located on the
Northwest corner of Lanikaula & hinano Streets, and to build a steel warehouse for an
ongoing mini storage operation business.
a. PROTECT DESCRIPTION
The property is located at 383 East Lanikaula Street Bs consist of 22,500 square feet. The
proposed building would be a 6250 square foot steel prefab building, fifty feet by one
hundred twenty five feet. The property is rectangular shaped:112.5' x 200'. The
property is vacant at this time and has been for some time.
b REASONS FOR THE REQUEST OF REZONING T.M.K(3)2-2-36-90
I would like to request the change of zoning for this property to allow me to improve
this lot with a brand new structure and provide the space needed to continue my
current business operation. Its close proximity to the hazbor, college and airport are
very important factors for the operation. The storage business is environmentally
friendly, we cause no adverse effect on the community and provide a needed service to
the community. It is a very quiet daytime operation, with no fumes, dust, excessive
noise, or heavy traffic flow. This is a daytime business which closes daily at 5p.m.. On
average, my customer activity per day is less than ten customers, usually two -five
people per day. A good percentage of my customer base are off-island customers.

The property consists of 22,500 square feet. The property is rectangular in shape:
112.5' x 200'.
d. PROPOSED BUILDING
The proposed building would be 6250 sq.ft., the dimensions of the building are 50' wide
by 125' long and 20' high steel prefab. There would be 21 parking stalls on the lot.
Landscaping will be provided to minimize the visual impact and enhance the overall
area.
e. TIMEFRAME AND COST
I would like to begin construction as soon as zoning would be approved. It would take
approximately one and a half years to complete construction. Approximate construction
costs is $350,000.00.
f. MEMBERSHIP SIZE, EMPLOYEES, AND CLIENTELE
The business - A & A Storage Company is a sole proprietor business. It only requires
one employee to run the daily operations. Currently it services about 150 customers,
and it is estimated that 50% of the customer base is off-island and 20% are college

7. COMMUNITY DEVELOPMENT PLAN
The Hilo Community Development Plan was adopted by the Planning Commission and
by the Council resolution in 1975. It was intended to further define the General Plan
and provide some short and middle range implementation strategies of the General
Plan. It should be noted that this Plan was adopted over twenty years ago, and the
General Plan has been revised three times since then. During this period, there have
also been significant land use developments in the city of Hilo, such as the shopping
area in and around the Puainako / Kanoelehua Intersection, expanded commercial uses
near educational complexes, and expanded commerciaUindustrialuws along the
southern portion of the Waiakea Houselots area. These developments may render many
land use concepts espoused in the Community Development Plan obsolete.

The subject property is located in the Waiakea Houselots area, on the corner of
Lanikaula and Hinano Streets. It is 22,500 square feet and rectangular shaped, two
hundred feet by one hundred twelve and half feet [200' x 112.5']. The mean annual rain
fall is about one hundred thirty six inches. The mean annual temperature is about
seventy three degrees Fahrenheit. Wind patterns are generally trade winds [easterly]
during the day, and westerly during the evenings. The soil type is Papai which is
chazacterized as stony muck.
10. LAVA HAZARD ZONE
The U.S. Geological survey classifies the area as Lava Flow Hazazd Zone 3, on a scale
ascending risk 9 to 1. The entire city of Hilo falls in this category. There is very little that
can be done to mitigate this situation and reflects an ongoing threat to all residents and
businesses in the Hilo area.

17. AIR /NOISE/WATER QUALITY
Lanikaula Street serves a major thoroughfare in this area, connecting Kancelehua Ave.
to Kilauea St.; the ambient noise level from traffic is quite high. The site is also close to
the Hilo airport, so there is also some air traffic noise. Therefore, I don t feel that the
proposed project would have negligible noise impacts to the surrounding properties.
The property has county water and sewer. As the project will be sewered, there should
be very little, if any, impacts to the coastal waters resulting from this project. Being a
non-shoreline lot, it should also not have any impacts to existing or planned access to
the shoreline. The business/building should not generate any direct air quality impacts.
The only impact could be associated with vehicular traffic, which I consider would be
very minimal based on current activity.
1.8. HISTORIC RESOURCES
This property is not deemed to be significant to warrant inclusion on the State or
National Register of Historic Sites. As the site has been previously disturbed, it is very
unlikely that surface & subsurface remains would be found on the site.
19. NATURAL RESOURCES
NATURAL RESOURCES OF FLORA /FAUNA
As the site had been previously used as a residence for nearly 85 years, the only
vegetation on the site are introduced landscape plants. The probability of discovering
rare or endangered plant life on the site appears to be remote. Further, as the site has
been disturbed, it is very unlikely that the site would currently serve as a habitat for
rare or endangered animal species.
SCENIC OR COASTAL RESOURCES
The Hilo area is underlain by basal groundwater. The Wailoa River is approximately
mile from the subject site. The ocean is located about two miles away. As the project
will be sewered, there should be very little, if any, impacts to the coastal waters
resulting from this project. Being anon-shoreline parcel, it should not have any impacts
to existing or planned access to the shoreline.

Although the area is zoned residential, there are several businesses nearby, and the
Hilo college campuses. The possible economic impact that may happen due to the zone
approval would be a positive impact for neighboring properties as this property value
would increase, making lots valuable, it may also cause property tax evaluations to

We have reviewed the subject application forwarded by your memo dated April 4, 2007 and offer
the following comments for your consideration.
All development-generated runoff shall be disposed of on site and shall not be directed toward any
adjacent properties. A drainage study shall be prepared and the recommended drainage system
shall be constructed meeting the approval of the Department of Public Works.
The subject parcel is in an area designated as Zone X on the Flood Insurance Rate Map (FIRM)
by the Federal Emergency Management Agency (FEMA). Zone X is an area determined to be
outside the 500-year floodplain.
AI earthwork activity, including grading and grubbing, shall conform to Chapter 10, Erosion and
Sedimentation Control, of the Hawaii County Code.
The Zoning Map (Ordinance No. 187) classifies Lanikaula Avenue as a secondary arterial of 80 feet
width and Hinano Street as a collector of 60 feet width. The General Plan (facilities map) classifies
Lanikaula Avenue as a collector.
Provide a minimum 20-ft corner radius (property line) at the intersection of the Lanikaula Avenue
and Hinano Street incorporating the future road widening setbacks as established by the Planning
Department.
We recommend the applicant provide improvements to the entire frontages along Lanikaula
Avenue and Hinano Street consisting of, but not limited to, pavement widening with concrete curb,
gutter and sidewalk, drainage improvements, and any required utility relocation, meeting the
approval of the Department of Public Works. The improvements shall be located within the future
road widening setbacks.
Streetlights and traffic control devices shall be installed as may be required by the Traffic Division,
Department of Public Works. The applicant shall be responsible for the design, purchase, and
installation of such devices.

SOLID WASTE MANAGEMENT PLAN
Guidelines
INTENT AND PURPOSE
This is to establish guidelines for reviewing solid waste management plans, for which
special conditions are placed on developments. The solid waste management plan will
be used to: (1) encourage recycling and recycling programs, (2) predict the waste
generated by the proposed development to anticipate the loading on County transfer
stations, landfills and recycling facilities, and (3) predict the additional traffic being
generated because of waste and recycling transfers.
REPORT
The consultant's report will contain the following:
1. Description of the project and the potential waste it may be generating: i.e.
analysis of anticipated waste volume and composition. This includes waste
generated during the construction and operational phases. Greenwastes will be
included in this report for both construction grubbing and future operational
landscape maintenance.
2. Description and location of the possible sites for waste disposal or recycling. We
will not allow the use of the County transfer stations for any commercial
development; commercial development as defined under the policies of the
Department of Environmental Management, Solid Waste Division.
3. Since the Department of Environmental Management promotes recycling,
indicate onsite source separation facilities by waste stream; i.e. source
separation bins of glass, metal, plastic, cardboard, aluminum, etc. Provide ample
and equal space for rubbish and recycling.
4. Identification of the proposed disposal site and transportation methods for the
various components of the waste disposal and recycling system, including the
number of truck traffic and the route that truck will be using to transport the waste
and recycled materials.

5. The report will include any impacts to County waste and recycling facilities, and
the appropriate mitigation measures. All recommendations and mitigation
measures will be addressed.
6. Description of the waste reduction component that analyzes techniques to be
employed to achieve a reduction goal.
7. Analysis will be based on the highest potential use or zoning of the development.
REQUIREMENTS AND CONDITIONS
1. A solid waste management plan will be done for all commercial developments, as
defined under the policies of the Department of Environmental Management,
Solid Waste Division.
2. We will require the developer to provide or resolve all recommendations and
mitigation measures as outlined in the report; besides any conditions placed on
the applicant by the Department of Environmental Management.
3. A licensed environmental or civil engineer will draft and certify the solid waste
management plan.

"Sec. 10.207. (a) General. Fire apparatus access roads shall be provided and maintained in
accordance with the provisions of this section.
"(b) Where Required. Fire apparatus access roads shall be required for every building
hereafter constructed when any portion of an exterior wall of the first story is located more
than 150 feet from fire department vehicle access as measured by an unobstructed route
azound the exterior of the building.
"EXCEPTIONS: 1. When buildings are completely protected with an approved
automatic fire sprinkler system, the provisions of this section may be modified.
" 2. When access roadways cannot be installed due to topography, waterways,
nonnegotiable grades or other similar conditions, the chief may require additional
fire protection as specified in Section 10.301 (b).

" 3. When there are not more than two Group R, Division 3 or Group M Occupancies,
the requirements of this section may be modified, provided, in the opinion of the
chief, fire-fighting or rescue operations would not be impaired.
"More than one fue appazatus road may be required when it is determined by the chief that
access by a single road may be impaired by vehicle congestion, condition of terrain, climatic
conditions or other factors that could limit access.
"For high-piled combustible storage, see Section 81.109.
"(c) Width. The unobstructed width of a fire apparatus access road shall meet the
requirements of the appropriate county jurisdiction.
"(d) Vertical Clearance. Fire apparatus access roads shall have an unobstructed vertical
clearance of not less than 13 feet 6 inches.
"EXCEPTION: Upon approval vertical cleazance may be reduced, provided such
reduction does not impair access by fire apparatus and approved signs are installed
and maintained indicating the established vertical clearance.
"(e) Permissible Modifications. Vertical clearances or widths required by this section may
be increased when, in the opinion of the chief, vertical clearances or widths aze not adequate
to provide fire apparatus access.
"(f) Surface. Fire apparatus access roads shall be designed and maintained to support the
imposed loads of fire apparatus and shall be provided with a surface so as to provide all-
weather driving capabilities." (20 tons)
"(g) Turning Radius. The turning radius of a fire apparatus access road shall be as
approved by the chief." (45 feet)
"(h) Turnarounds. All dead-end fire appazatus access roads in excess of 150 feet in length
shall be provided with approved provisions for the fuming around of fire apparatus.
"(i) Bridges. When a bridge is required to be used as access under this section, it shall be
constructed and maintained in accordance with the applicable sections of the Building Code
and using designed live loading sufficient to carry the imposed loads of fire apparatus.
"(j) Grade. The gradient for a fire apparatus access road shall not exceed the maximum
approved by the chief." (15%)

"(k) Obstruction. The required width of any fire apparatus access road shall not be
obstructed in any manner, including parking of vehicles. Minimum required widths and
clearances established under this section shall be maintained at all times.
"(1) Signs. When required by the fire chief, approved signs or other approved notices shall
be provided and maintained for fire apparatus access roads to identify such roads and
prohibit the obstruction thereof or both."
Water supply shall be in accordance with UFC Section 10.301(c):
"(c) Water Supply. An approved water supply capable of supplying required fire flow for
fire protection shall be provided to all premises upon which buildings or portions of
buildings are hereafter constructed, in accordance with the respecfive county water
requirements. There shall be provided, when required by the chief, on-site fire hydrants and
mains capable of supplying the required fire flow.
"Water supply may consist of reservoirs, pressure tanks, elevated tanks, water mains or other
fixed systems capable of providing the required fire flow.
"The location, number and type of fire hydrants connected to a water supply capable of
delivering the required fire flow shall be protected as set forth by the respective county water
requirements. All hydrants shall be accessible to the fire department apparatus by roadways
meeting the requirements of Section 10.207.

CHANGE OF ZONE APPLICATION (REZ 07-000065)
Upon careful review of the request against the guidelines for granting a change of zone,
the Planning Director recommends that a favorable recommendation of the Change of Zone
from Single-Family Residential 10,000 square feet (RS-10) to Industrial-Commercial Mixed
20,000 square feet (MCX-20) be forwarded to the Hawaii County Council. Since this
recommendation is made without the benefit of public testimony, the Director reserves the right
to modify and/or alter this recommendation based upon additional information presented at the
public hearing. This favorable recommendation is based on the following fmdings:
The applicant is requesting a Change of Zone from Single-Family Residential
10,000 square feet (RS-10) to Industrial-Commercial Mixed 20,000 square feet (MCX-
20) for 22,500 square feet of land. The applicant is proposing to construct a 6,250-square
foot steel framed building, which will be used as a self storage business with an office.
In order to consider an area for any type of zoning designation, the applicable
goals, policies and standards of the General Plan must be adequately addressed. It is only
through such a comprehensive policy analysis approach that evaluations and decisions
can be made to better time and stage developments to achieve growth determined by the
General Plan and related planning documents. The implications of these evaluations and
decisions must also be considered as they may have an impact on similar areas in the
County.
The Change of Zone request from Single-Family Residentia110,000 square
feet (RS-10) to Industrial-Commercial Mixed 20,000 square feet (MCX-20) will
conform to the goals, policies and standards of the General Plan Economic and
Land Use Elements. The General Plan is intended to be used as a policy guide for the
coordinated growth and development of all sectors of the County. It sets forth goals,
policies, standards and courses of action to accommodate growth without congestion, to
designate and preserve the lands needed for residential use, commercial and visitor
services, industry, agriculture and open space, and to coordinate these uses with the
County's service and circulation systems. The overall goals, policies and standards are
set forth to physically plan the lands in the County in the best interest of the island's
residents. Land Use is one of the principal focal points of public concern and policy.
The Land Use Element provides the primary basis for direct control and guidance of
publicly and privately owned resources.
The request conforms to the goals, policies and standards of the General Plan in
that the proposed development will be developed in an area adequately served by
necessary services such as water, utilities, sewers and transportation systems. The
proposed project also conforms to the Land Use -Industrial sub-element which states that
"Industrial development shall be located in areas adequately served by transportation,
utilities and other amenities."
The Land Use Pattern Allocation Guide (LUPAG) Map component of the General
Plan is a representation of the document's goals and policies to guide the coordinated
growth and development of the County. It reflects a graphic depiction of the physical
relationship among the various land uses. The LUPAG Map establishes the basic urban
and non-urban form for aeeas within the County. The project area is designated Industrial
on the LUPAG Map. This industrial designation includes uses such as manufacturing
and processing, wholesaling, large storage and transportation facilities and light industrial
uses. The MCX zoning would be consistent with the Industrial designation on the
LUPAG Map for this area of Hilo.
The State Land Use designation for the subject property is Urban. The Hilo
Community Development Plan (CDP) adopted in 1975 suggests the retention of
residential uses in this area. However, this area is transitioning to commercial and light
industrial uses. The advantage of this area is its location in close proximity to water, air
transportation terminals, hazbor facilities and the residential population of Hilo. The
proposed change of zone would complement the existing industrial and commercial land
uses that already exist in this area and will provide for an orderly development of the
azea.
The MCX zoning designation was created when the Zoning Code was amended in
1996. hi accordance with Section 25-5-130, Hawaii County Zoning Code, this district

would allow a mix of light industrial and commercial uses. The intent is to provide for
areas of diversified businesses and employment opportunities by permitting a broad range
of uses, without exposing non-industrial uses to unsafe and unhealthy environments.
The property is 22,500 square feet in size and is rectangular in shape. It is located
on the northwest corner of Lanikaula Street and Hinano Street. The applicant is proposing
to relocate her current storage business to the new facility, which will be a 6,250-square
foot steel framed building for self storage and an office.
The land uses in the immediate area are a mix of residential, commercial, and
industrial uses. Industrial-commercial uses to the east include a small shopping complex
on the corner of Lanikaula Street and Laukapu Street zoned ML-20 by Ordinance No. 94
5 (REZ No. 757). Businesses in the shopping complex include Sputnik's, Affordable
Catering, Punahele Bake Shop, and Dino's Fish and Tackle, among others. Across the
shopping complex aze two pazcels iecently zoned to MCX-20 by Ordinance No. 06-146
(REZ No. 06-000043), which will be used as office and storage space for an engineering
firm. To the south on Hinano Street is a cazpet business and an electrical business on
properties zoned ML-10. To the west on the corner of Lanikaula and Manono Street is a
property zoned ML-20. This property consists of businesses such as Hawaii Farm
Services, Mid Pacific Wheels, Doc Stanley's Repair, Hawaiian Island Glass Tinting and
Auto Shine, which aze within a warehouse structure. To the north on Hinano Street are
single family dwellings. Immediately adjacent properties are zoned RS-10 and consist of
single-family residential uses.
All utilities and services are available to the site. Access to the project site
will be from Lanikaula Street, which is a County roadway with an approximate pavement
width of 22-24 feet within a 50-footright-of way. On-site paved parking will be
available. As part of the rezoning approval, the property will be required to set aside a
5-foot future road widening strip along Lanikaula Street and Hinano Street, and provide
a 20-foot corner radius at the intersection. Additionally, the applicant will be required to
provide improvements to the entire frontage along Lanikaula Street and Hinano Street,
consisting of, but not limited to, pavement widening with concrete curb, gutter and
sidewalk, drainage improvements, and any required utility relocation. County water is

available to the site. The project will connect to the County sewer system. Solid waste
will be handled by commercial haulers. Electricity and telephone services are available
to the site.
The property has no severe geological or topographical problems which cannot be
rectified or which would render the land unusable. The project site is located within
Zone "X", azea determined to be outside the 500-year floodplain. All development
generated storm run-off shall be disposed of on-site and not allowed onto adjacent
properties or roadways.
The subject request is not contrary to Chapter 205A, Hawaii Revised
Statues, relating to Coasta? Zone Management. The project site is not located in the
Special Management Area. The property is located approximately two miles from the
shoreline and will not be impacted by coastal hazazd and beach erosion. There is no
record of a designated public access to the shoreline or mountain areas that traverses the
property. No valued cultural, historical or natural resources exist on the property and
there is no evidence of any traditional and customary Native Hawaiian rights being
practiced on the site. Thus, it is not anticipated that the proposed request will have any
adverse impact on cultural or historical resources in the area. Therefore, no action is
necessary to protect these rights.
Based on the above findings, approval of this change of zone request from
Single-Family Residential 10,000 square feet (RS-10) to Industrial-Commercial
Mixed 20,000 square feet (MCX-20) would result in an appropriate land use pattern that
will further benefit the general public.
The accompanying draft bill to amend Section 25-8-33 (City of Hilo Zone Map),
Chapter 25 (Zoning Code) of the Hawaii County Code, is provided for your favorable
consideration. Please note the proposed conditions of approval attached to the draft bill.

CHANGE OF ZONE APPLICATION (REZ 07-000065)
CONDITIONS OF APPROVAL
A. The applicant, its successors or assigns shall be responsible for complying with all
of the stated conditions of approval.
B. The required water commitment payment shall be submitted to the Department of
Water Supply in accordance with its "Water Commitment Guidelines Policy"
within ninety days from the effective date of this ordinance.
C. Construction of the proposed development shall be completed within five (5)
years from the effective date of this ordinance. Prior to construction, the
applicant, successors or assigns shall secure Final Plan Approval for the proposed
development from the Planning Director in accordance with Chapter 25-2-70,
Chapter 25 (Zoning Code), Hawaii County Code. Plans shall identify all existing
and/or proposed structures, paved driveway access and pazking stalls associated
with the proposed development. Landscaping shall also be indicated on the plans
for the purpose of mitigating any adverse noise or visual impacts to adjacent
properties in accordance with the requirements of Planning Department's Rule
No. 17 (Landscaping Requirements) and Section 25-5-137 (Landscaping of Yards
in the MCX District).
D. Access to the project site shall meet with the approval of the Deparhnent of Public
Works.
E. The applicant shall provide full improvements to the entire frontage of Lanikaula
Street and Hinano Street consisting of, but not limited to, pavement widening with
concrete curb, gutter and sidewalk, drainage improvements and any required
utility relocation, meeting with the approval of the Department of Public Works.
The improvements shall be located within five-foot future road widening strips
along the Lanikaula Street and Hinano Street frontages and be dedicated to the
County of Hawaii prior to the issuance of a Certificate of Occupancy.
F. The applicant shall provide a minimum 20-foot corner radius (property line at the
intersection of Lanikaula Street and Hinano Street incorporating the 5-foot future
road widening setbacks.
G. Streetlights and traffic control devices shall be installed as required by the
Department of Public Works.
H. All development generated runoff shall be disposed of on site and shall not be
directed toward any adjacent properties.
I. A drainage study shall be prepared and submitted to the Department of Public
Works prior to the issuance of Final Plan Approval. If required, any drainage
improvements shall be constructed, meeting with the approval of the Department
of Public Works prior to the issuance of a Certificate of Occupancy.
J. The project shall connect to the existing County sewerline prior to the issuance of
a Certificate of Occupancy.
K. A Solid Waste Management Plan shall be submitted to the Department of
Environmental Management for review and approval prior to the issuance of a
Certificate of Occupancy.
L. Should any remains of historic sites, such as rock walls, terraces, platforms,
marine shell concentrations or human burials be encountered, work in the
immediate area shall cease and the Department of Land and Natural Resources -
State Historic Preservation Division (DLNR-HPD) shall be immediately notified.
Subsequent work shall proceed upon an archaeological clearance from DLNR-
HPD when it finds that sufficient mitigation measures have been taken.
M. Should the Council adopt a Unified Impact Fees Ordinance setting forth criteria
for imposition of exactions or the assessment of impact fees, conditions included
herein shall be credited towards the requirements of the Unified Impact Fees
Ordinance.
N. The applicant shall comply with all County, State and Federal laws, rules,
regulations and requirements.
O. An annual progress report shall be submitted to the Planning Director prior to the
anniversary date of enactment of the ordinance. The report shall include, but not
be limited to, the status of the development and the extent to which the conditions
of approval have been satisfied. This condition shall remain in effect until all of

the conditions of approval have been satisfied and the Planning Director
acknowledges that further reports are not required.
P. An initial extension of time for the performance of conditions within the
ordinance maybe granted by the Planning Director upon the following
circumstances:
1. The non-performance is the result of conditions that could not have been
foreseen or are beyond the control of the applicant, successors or assigns,
and that are not the result of their fault or negligence.
2. Granting of the time extension would not be contrary to the General Plan
or Zoning Code.
3. Granting of the time extension would not be contrary to the original
reasons for the granting of the change of zone.
4. The time extension granted shall be for a period not to exceed the period
originally granted for performance (i.e., a condition to be performed
within one year maybe extended For up to one additional yeaz).
5. If the applicants should require an additional extension of time, the
Planning Director shall submit the applicants' request t0 the County
Council for appropriate action.
Should any of the conditions not be met or substantially complied with in a timely
fashion, the Planning Director may initiate rezoning of the area to its original or more
appropriate designation.
