RESOLUTION NO. 296 07
A RESOLUTION TO AMEND RESOLUTION 544-06, WHICH PRIORITIZED LANDS
TO BE ACQUIRED PURSUANT TO SECTION 2-218(a) OF THE HAWAII COUNTY
CODE 1983 (2005 EDITION, AS AMENDED).
WHEREAS, the Council of the County of Hawaii, by Resolution No. 544-06, adopted
on November 29, 2006, resolved that pursuant to section 2-218(a), Hawaii County Code 1983
(2005 Edition, as amended) (the Code), the acquisition of lands to be financed in accordance
with the terms of chapter 2, article 42 of the Code, shall be prioritized as follows:
1. The acquisition of Kawa`a/Kawa`a Bay;
2. The acquisition of the Waipi`o Lookout Point Pazcel;
3. The acquisition of the Honoli`i Gulch Property; and
4. The acquisition of the Puapua` a Properties; and
WHEREAS, the director of finance, pursuant to the provisions of subsections 2-218(a)
and (d) of the Code, shall make every effort to follow the Council's priorities, as set by the
adoption of a resolution, with regazd to the acquisition of lands using Public Access, Open
Space, and Natural Resources Preservation funds; and
WHEREAS, the Kawa`a/Kawa`a Bay properties include the pazcels with tax map keys
(TMKs): 9-5-016-006, 9-5-016-025, 9-5-017-OOS,and 9-5-017-007; and
WHEREAS, at the time this resolution is being drafted, negotiations for the
Kawa`a/Kawa`a Bay properties aze still in progress; and
WHEREAS, the Council of the County of Hawaii has adopted resolutions for the
acquisition and preservation of those properties ranked as number one and number two by
Resolution No. 544-06 (Resolution No. 427-06 for the acquisition of the Waipi`o Lookout Point
Parcel and Resolution No. 451-06 for the acquisition of Kawa`a/Kawa`a Bay); and
WHEREAS, the acquisition of these specified properties is to be financed in accordance
with the terms of chapter 2, article 42 of the Code; and
WHEREAS, the Public Access, Open Space, and Natural Resources Preservation
Commission listed the following reasons for the Waipi`o Lookout Point Parcel's significance to
the County of Hawaii:
• "It is located as the gateway to Waipi`o Valley."
• "It would enhance the existing County Waipi`o Lookout Facilities by providing
safety, cultural, and historic information to visitors and residents."
• "It could also provide additional pazking to the Lookout area."; and
WHEREAS, the Waipi`o Valley Task Force along with the Rice Property Working
Group was formed with residents of Waipi`o Valley, Kukuihaele and other concerned members
of neighboring communities and created a foundation for a steering committee; and
WHEREAS, this steering committee has been diligently working with the county to
establish a Ranger Program that will educate students and visitors about the history, uniqueness,
and special resources Waipi`o Valley offers, which will greatly help to protect the sanctity and
sacred nature of Waipi`o Valley; and
WHEREAS, the County Department of Research and Development was awazded a
$60,000 grant from the Hawaii Tourism Authority for the establishment of a Ranger Program;
and
WHEREAS, the Rice Property Working Group has announced that two individuals have
been hired for the Ranger Program and will begin work on August 6, 2007; and
WHEREAS, as mentioned in the Public Access, Open Space and Natural Resources
Preservation Commission's prioritized list to the Mayor, the Waipi`o Lookout Point Pazcel
would be suitable and could very well serve as a future Ranger Station; and
WHEREAS, the owners of the Waipi`o Lookout Point Parcel have formally agreed to
the County's offer, and the property is immediately available for sale to the County of Hawaii at
its appraised value; and
WHEREAS, the acquisition of the Waipi`o Lookout Point Pazcel, as initiated by
Resolution 427-06, should be finalized based on:
L this amendment to Resolution No. 544-06, the County Council's prioritized list for
property acquisition;
2. the criteria previously established by Resolution No. 427-06;
3. the criteria scoring and ranking as established by the Public Access, Open Space, and
Natural Resources Preservation Commission on its prioritized list of qualifying lands
worthy of preservation dated November 29, 2006;
4. the prerequisites and provisions of chapter 2, article 42 of the Code; and
5. the acceptance of the "at or below appraised value" offer made by the county to the
proprietors of the Waipi`o Lookout Point Parcel; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the
prioritized list for acquisition of land financed in accordance with the terms of chapter 2, article
42 of the Code and established by Resolution No. 544-06, be amended as follows:
1. The acquisition of Kawa`a/Kawa`a Bay and Waipi`o Lookout Point Parcels;
2. The acquisition of the Honoli`i Gulch Property; and
3. The acquisition of the Puapua`a Properties.

BE IT FURTHER RESOLVED, that the Mayor and his administration are requested to
finalize the acquisition process, as initiated by Resolution No. 427-06, of the Waipi`o Lookout
Point Parcel (also referred to as the "Rice Parcel"), more particularly designated as tax map key
parcel (3) 4-8-004:006 and comprised of approximately 1.804 acres; and
BE IT FINALLY RESOLVED, that the County Clerk shall forward a copy of this
resolution to the Mayor, director of finance and the proprietors of TMK (3) 4-8-004-006, also
referred to as the "Rice Parcel".
