SV Os„ <br /> ~L~~ <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> ••••h•O!•M~~`' <br /> RESOLUTION NO. 293 0'7 <br /> RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A LEASE <br /> OF REAL PROPERTY, ULULANI STREET EXTENSION, SITUATE AT WAIAKEA, <br /> SOUTH HILO, COUNTY AND STATE OF HAWAII, IDENTIFIED AS TAX MAP <br /> KEY:(3)2-4-057:031, TO THE HAWAII ISLAND VETERANS MEMORIAL, INC. <br /> WHEREAS, the County of Hawaii is the owner of a real property pazcel described as <br /> <br /> the Ululani Street Extension, consisting of Pazcels 1, 2, and 3, situate at Waiakea, South Hilo, <br /> County and State of Hawaii, being Tax Map Key:(3)2-4-057:031, and delineated on Exhibit "A" <br /> attached hereto <br /> WHEREAS, the Hawaii Island Veterans Memorial, Inc., anon-profit organization, <br /> desires to lease that property from the County, for the purpose of construction and development <br /> of a combined veterans center, veterans housing, and other related purposes; and <br /> WHEREAS, the Council of the County of Hawaii previously approved the negotiation <br /> of a lease with the Hawaii Island Veterans Memorial, Inc., for the main parcel through <br /> Resolution 168-04, under similaz terms and conditions; and <br /> WHEREAS, Section 2-120 (a) (2) of the Hawaii County Code provides that the <br /> Council of the County of Hawaii may, by resolution approved by a majority of its members, <br /> direct the finance director to negotiate the lease of real property to nonprofit organizations, at <br /> such rentals and on such terms and conditions as deemed proper; and <br /> WHEREAS, Section 2-120 (b) provides such lease of real property to nonprofit <br /> organizations may be made without the notice or appraisal as required in Chapter 2, Article 19 of <br /> the Hawaii County Code. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY <br /> OF HAWAII, that under Chapter 2, Article 19, Section 2-120 (a) (2) of the Hawaii County <br /> Code, the Director of Finance is hereby authorized to negotiate a 3-year lease (with additional <br /> renewal options of 5-year increments) with the Hawaii Island Veterans Memorial, Inc., a <br /> nonprofit organization, without notice or appraisal, for the property identified as Parcels 1, 2 and <br /> 3, Tax Map Key:(3)2-4-057:03. <br /> <br />
