AN ORDINANCE AMENDING CHAPTER 18, ARTICLE 4, DIVISION 1, SUBSECTION 18-90(H), HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PUBLIC TRANSPORTATION BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose and findings. The purpose of this ordinance is to extend the original two-yeaz time period to run through December 31, 2009. The Hawaii County Transportation Administrator is seeking to amend chapter 18, article 4, division 1, subsection 18-90(h), of the Hawaii County Code 1983 (2005 Edition, as amended), to allow for an extension of time for the County of Hawai`i's transportation kokua zone, wherein riders boazding and alighting any regularly-scheduled bus route operated by the County of Hawaii, or its designee, shall ride free of charge. Subsection 18- 90(h)(4) specifically states "[A] designated transportation kokua azea shall terminate two years after its implementation, unless extended or terminated by the Council." SECTION 2. Chapter 18, article 4, division 1, subsection 18-90(h), Hawaii County Code 1983 (2005 Edition, as amended), is amended to read as follows: "(h) Island-wide transportation free zone. (1) The purpose of this subsection is to provide the public with a transportation alternative to the private automobile. The provision of an effective public transportation system for the residents of the County of Hawaii will produce economic, social and lifestyle benefits for the residents of Hawaii County. The distances residents must travel for work, medical, education, and social needs will be alleviated by providing public transportation at no cost to the user. (2) The County of Hawaii shall be designated a transportation kokua zone. Riders boarding and alighting any regularly scheduled bus route operated by the County of Hawaii or its designee shall ride free of charge. (3) The transportation kokua zone shall not apply to County contracted shared-ride taxi services, County operated curb to curb van services, or County operated non-scheduled bus services. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
