SUBJECT: Transmitting An Ordinance Amending Chapter 27, Flood Control, Hawaii
County Code 1983 (2005 Edition, as amended), Relating to Floodplains and Other
Flood Hazard Areas.
Submitted for your consideration is a bill to amend chapter 27 of the Hawaii County Code,
relating to flood control. This bill is one of the products of a series of discussions between
administration staff and me relating to addressing the issue of flood control in our County.
Participants in the discussion included Director Bruce McClure and Deputy Director Jiro
Sumada of the Department of Public Works, Deputy Director Brad Kurokawa from the Planning
Department, staff from those two departments as well as from the County Clerk's office, and me.
This new bill reflects our efforts to satisfy the minimum National Flood Insurance Program
(NFIP) requirements and includes additional changes to chapter 27 as well.
These changes include:
1. Color highlighting to indicate NFIP minimum requirements (blue) and increased standards
(yellow)
2. Additional purpose statements
3. Control relocation of watercourses
4. Chapter applicability to Zone X (shaded and not shaded)
5. New definitions and changes to definitions
6. Hawaii State licensing of contractors, engineers, and architect with regard to this Chapter
7. Increased number of years for substantial improvements
8. DPW review of development approvals for compliance to Chapter 27

9. Requirements and maintenance of new State and Federal permits associated with new
projects (effective 3-31-08)
10. LOMR requires independent review and field visit
11. Establish civil fine for failure to provide "as built" plans, other required documentation,
and complete LOMR submission(s) by 60`h day from completion of change to floodplain at
$1,000.00 per day
12. Expansion of floodplain administrator duties
13. Inclusion of "improvements to repetitive loss structures" in several areas of Chapter 27
14. Addition of freeboard to elevations
15. Inclusion of Zone X (shaded and not shaded) in standards of construction (effective 3-31-
08)
16. Additional Zone A requirements for subdivisions
17. Additional Zone X requirements for subdivisions
18. Increase to 1-hour, 25-year storm event for disposal ofpost-development discharge
(Effective 3-31-08) (Exceptions: single family dwellings, duplexes, and ohanas)
In order to meet the pending deadline to satisfy the National Flood Insurance Program
requirements, I ask that this bill be waived from the Public Works and Intergovernmental
Relations Committee to the full Council for first reading on August 15, 2007. During the
Council meeting, we would appreciate the opportunity to make a brief presentation about the
work that has taken place as well as to discuss the contents of the bill.

RE: Bill No. 151 AN ORDINANCE AMENDING CHAPTER 27, FLOOD
CONTROL, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED),
RELATING TO FLOODPLAINS AND OTHER FLOOD HAZARD AREAS.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Public Works and Intergovernmental Relations Committee to the full Council
for immediate action. In reviewing this matter, timely approval is crucial. It is therefore
advantageous that approval is granted and the matter placed onto the next Council agenda for
review. However, in the event this request is denied, for whatever reason, I understand the
matter shall be referred to the Public Works and Intergovernmental Relations Committee for
placement on its future agenda.
