Generally, the Department :ha:; no objections to the proposed amendment. For your and the County Council's information, the Department of Water Supply is respDnsi~de for the operation and mainteuance of the County's water systems in accordance with the Hari ~ti .County Chartez and the Department's Rules and Regulations. The Ru1ts and Regulations are a~railah'e on the Department's website, vnvw.hawaiidws.ore. More specifically, reference is made to RULE S -WATER COMMITMENTS. I'h~.: pen~rg paragraph of this rule states, "If the Department, on the basis of population data, avaiLrb lity of water, existence of water sources, waterlines or other facilities, engineering requirements, art9 other rE:lated and relevant data, anticipates that a consumer, developer or subdivider Can be providE~ 9 ~ ~itla sufficient water for the estimated usage of a proposed new project or development, meeting the :.1: partmt:nt's minimum standards, the Department may commit to the consumer, developer or subdiv:dE•.r tl•at there is, or it is anticipated that there wiA be, sufficient water to service the proposed ne~+ project or development. The Department, in giving such a water commitment, may impose tivL limits and other conditions for the use of such commitment upon the consumer, developer or subdivider, as the Department deems necessary. The Board may establish guidelines ,real policies for the issuance of formal written water commitments." Guidelines follow tt , ~ era€~aph. The Department aurently issues water commitments in accordance with Rule 5, and -.:u dar.r. so for the past thirty years or so.
