HomeMy WebLinkAboutRES 302 Draft 01 2006-2008 OFFICE INFORMATION ONLY Meeting: Finance Committee - September 5, 2007 Action: Withdrawn by introducer (Emily Naeole) on the floor Re: Res. 302 -07 (Comm. 604) (2006 -2008) +Tr or x_ ~P:'•.~;_' Vii COUNTY OF HAWAII STATE OF HAWAII • 'ij~ p,•N~,~~ RESOLUTION NO. 3U2 U~ A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO ENTER INTO NEGOTIATIONS FOR THE ACQUISITION OF OCEAN PARK IN THE DISTRICT OF PUNA, PURSUANT TO CHAPTER 2, ARTICLE 42, HAWAII COUNTY CODE, 1983 (2005 EDITION, AS AMENDED). WHEREAS, chapter 2, article 42, section 2-214, Hawaii County Code, established the Public Access, Open Space, and Natural Resources Preservation Fund; and WHEREAS, section 2-215, Hawaii County Code, established the Public Access, Open Space, and Natural Resources Preservation Commission (Commission); and WHEREAS, section 2-218(a), Hawaii County Code, in pertinent part, states, "Where there are multiple lands under consideration at any one time, priority shall be given to coastal lands and lands where matching funding is available to leverage the County contribution"; and WHEREAS, per a 1961 final subdivision approval granted by the Department of Planning, the developer set aside a minimum of 10 acres for parks/open space, which includes the Ocean Park, along with the parks at Honu Street and Malolo Street; and WHEREAS, two parcels in the Hawaiian Shores subdivision that lie between Papio Street and the ocean were designated Ocean Park on a 1981 deed to the Hawaiian Shores Community Association; and WHEREAS, the Hawaiian Shores Community Association has expressed an interest in selling this property to raise funds for improvements to its private roads and water system, resulting in residential development on these two coastal parcels; and WHEREAS, in the interest of protecting Ocean Park, a coastal strip that abuts Honolulu Landing to the north, to be acquired are Tax Map Keys (TMK) 1-5-088-001, .70 acres, and 1-5- 111-001, 2.7 acres; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Director of Finance is authorized to enter into negotiations for the acquisition of Ocean Park, TMK: 1-5-088-001 and TMK: 1-5-I 11-001, in the District of Puna, pursuant to the terms of this resolution; and BE IT FURTHER RESOLVED that the Director of Finance is hereby authorized to initiate any funding mechanisms required for the acquisition of Ocean Park, in accordance with chapter 2, article 42, Hawaii County Code, relating to the Public Access, "Open Space, and Natural Resources Preservation Fund and Commission; and BE IT FURTHER RESOLVED that the Hawaii County Council welcomes individuals who aze willing to shaze their expertise and engage with others in an open process to form a new non-profit solely dedicated to the management of Ocean Pazk; and BE IT FURTHER RESOLVED that Contingency Relief funds from District 5 would be provided for facilitation services through the Department of Research and Development or by contract if the community desires help in building acommunity-based non-profit organization; and BE IT FURTHER RESOLVED that the Hawaii County Department of Pazks and Recreation and Hawaii County Land Management Division are requested to select a community-based non-profit organization that contains diverse community membership, namely with expertise in economics, education, Hawaiian cultural practices, shoreline management, fundraising and community building, and any other necessary skills to manage this public resource; and BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to Mayor Harry Kim, the Director of Finance, Governor Linda Lingle, the Director of the Department of Land and Natural Resources, Senators Daniel Inouye and Daniel Akaka, and Representatives Neil Abercrombie and Mazie Hirono.
