SUBJECT: Submitting Proposed Amendment t ill I51, Relating to Floodplains and Other
Floodplains and Other Flood Hazard Areas
Submitted herein for your consideration, please find a proposed amendment to Bill I51. This
would amend paragraph 27-18(3)(F), found on page 22 of Bi11 151, by adding the following
phrase before the last sentence in the paragraph:
"This paragraph shall not apply to special flood hazard zones V and VE."
The additional language, which is underlined and bolded, would appear as follows within the
existing language of paragraph 27-18(3)(F):
"F. Within areas where the grade of the natural elevation of the ground surface prior to
construction exceeds ten percent, filling, grading, and other development which
may increase flooding or erosion hazards shall be prohibited unless a professional
civil engineer licensed in the State of Hawaii certifies that the development will
contain its own runoff and not increase flooding or erosion in other areas. Creation
of impermeable surfaces on such sloping areas will be limited to no more than forty
percent of the total land area of any lot or proposed new subdivision. Any measures
to be implemented in order to prevent or decrease run-off or erosion shall be clearly
shown or described on the grading or infrastructure construction plan. This
paraHraph shall not apply to special flood hazard zones V and VE. This
provision, upon approval of this ordinance, shall take effect on March 31, 2008."
