Proof of mailing to surrounding property owners was received with letter dated July 19, 2007. The required affidavit and photograph were received on August 10, 2007. The subject parcels were created under the Kingsland Subdivision. Within this subdivision, the Kings' Golf Course included ponds as part of its design. TMK: 6-9-8:21 and 22, both zoned Multiple-Family Residential (RM-8), contain ponds. Upon review of the request, we have determined that it complies with the criteria set forth in Section 25-2-45(a)(1) of Chapter 25, Hawaii County Code, for determining non- significant zoning changes: 1) The adjustment of zoning boundaries will not result in any increase in the zoning densities. The total area of the adjustment for the Multiple Family Residential (RM-8) district and the Open (O) district is an equal 1.066 acres each. 2) The area under review is in compliance with the General Plan. The County of Hawaii General Plan (2005) became effective on February 9, 2005. The subject parcels are designated as "Resort Node" on the Land Use Pattern Allocation Guide (LUPAG) Map. 3) The changes will not result in a net increase in the density allowed in the zoning districts containing the affected area. A copy of such notice and a list of the names and addresses of the surrounding property owners .4 shall be submitted within one week from the date of filing of the nonsignificant zoning change. I. Description of the Property The proposed action involves small portions of the parcels created under the Kingsland Subdivision situated at the Waikoloa Beach Resort. This application affects portions of four ~ pazcels within the subdivision: two golf course pazcels (TMK 6-9-08:28 and 29) and two RM-8 zoned pazcels (6-9-08:21 and 22). The golf course parcels aze owned by the Waikoloa Development Company and the multiple-family residential zoned pazcels at issue in this ~ application aze owned by Hilton Kingsland 1, LLC. The total area of these four pazcels is about 202.121 acres. [See Figure 1] II. Purpose of the Request The Kings' Golf Course within the Kingsland Subdivision includes ponds as part of its design. There are, however, instances where the ponds aze partially within the multiple-family residential zoned lots. As shown in Figure 2, this application focuses on one pond azea within RM-8 zoned parcel, TMK 6-9-08:21, and one pond area within another RM-8 zoned pazcel, TMK 6-9-08:22. The applicant wishes eventually to reconfigure the multiple-family residential and golf course lot lines so that the subject ponds aze totally within the golf course Open-zoned lots and aze out of the multiple-family residential zoned lots. y.. To do this, the applicant proposes the following: 1) Adjust the zoning boundaries to place the ponds entirely within the Open zone. „ 2) Balance the zoning changes so there aze no net gains or losses in Multiple-Family Residential or Open zoned azeas. ar 3) Subdivide and consolidate to place the ponds entirely within the golf course. 'O This readjustment of the Open zone to include the pond azeas is an initial step towazds moving the ponds out of the multiple-family residential zoned lots and placing them entirely within the golf course lots. rr w ~ ~ ~ ~ III. Calculatlon of Net Zoning Area Changes The following table identifies the proposed zoning azea changes and calculates the net result on ~ the zoning districts. The table shows that the residential and open zone acreaees remain the same and as a consequence, the multinle-family residential densities are unchanged. Table 1. Calculation of Percentage of Land Area Changes The following table identifies the proposed zoning azea changes and calculates them as a ~ percentage of the zoning lot. The table shows that the azea changes range from 0.2461 to 0.82E acre and from 0.27 to 3.07%. As a consequence, the changes to each zoning area is less than 1 acre and less than 5%. rr - Table 2. Qualification for Nonsignificant Zoning Change (NZC) This proposed action qualifies for a nonsignificant zoning change for the following reasons: 1. The proposed multiple-family residential zoning is consistent with resort azea designation on the current General Plan Land Use Allocation Guide (LUPAG). 2. The proposed action results in no net change in multiple-family residential or open zoning and, as a consequence, results in no changes in the residential densities. 3.
