Re: Capital Budget
Enclosed is a bill for an ordinance adding the Konawaena Swimming Pool Improvement Project
for $750,000 to the Capital Budget. Some of the funding for this previously appropriated project
had lapsed on June 30, 2007. This bill reappropriates this project's funding into this fiscal year
budget as well as increasing it from $500,000 to $750,000. The original bid for this pool
improvement project was recently cancelled and will be going out again for bids. The increase
in the appropriation is requested to ensure sufficient appropriation capacity is available to
execute the construction contract upon execution of the re-bid and to allow for some
contingency in the bid process and during construction to accommodate increases in costs,
unforeseen conditions, or take advantage of additional work that may become necessary. This
project includes improvements to the swimming pool circulation system, pool basin, lighting
system, solar hearing system, re-roofing of the facility and other related or similar repairs or
upgrades necessary to ensure proper and safe operation of the pool facility.

A. REQUEST:
To amend Ordinance 07-83, as amended, the Capital Improvement Projects budget, to reappropriate
Account 110.599.5597.94.115 "Konawaena Swimming Pool Improvements" originally created via Ordinance
04-75 in the amount of $500,000, which lapsed June 30, 2007 and to increase said reappropriation from
$500,000 to $750,000.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
The subject reappropriation at the increased amount is required to supplement existing fully allotted
appropriations 110.599.5596.04.115 ($500,000) and 110.599.5596.10.115 ($750,000) that will fund
construction project B-3732R "Konawaena Swimming Pool Renovations".
The pool renovation project was originally bid on May 31, 2007 and the apparent low bidder's bid proposal
was received in the amount of $1,524,000. However, due to a calculation error in its bid preparation, the
contractor retracted its bid, which it says should have been $1,766,000. The next apparent low bidder's price
for the same work was $2,188,000, which exceeded the available project funding and far surpassed the price
the county may be able to realize by re-bidding the project. So, it was determined that the public's interest
was better served re-bidding the project rather than settling for the significantly higher bid amount or
negotiating to reduce the bid amount by compromising on the much needed full scope of work. Also, the
second lowest bidder's proposal exceeded available funding despite the potential collection of the initial low
bidder's bid bond. As such, the Department of Public Works officially cancelled the original bid and our
department has repackaged the bid documents in preparation for the re-bid.
The increase in the appropriation is requested to ensure sufficient appropriation capacity is available to
execute the construction contract upon execution of the re-bid and to allow for some contingency in the bid
process and during construction to accommodate increases in costs, unforeseen conditions or take
advantage of additional work that may become necessary or advantageous to execute in the prosecution of
this work.
