A RESOLUTION AMENDING RESOLUTION NO. 16-07, DRAFT 2, BY EXTENDING
THE TEMPORARY DELAY OF COUNCIL ACTION ON REZONING APPLICATIONS
IN THE DISTRICTS OF NORTH AND SOUTH KONA UNTIL THE NORTH AND
SOUTH KONA COMMUNITY DEVELOPMENT PLAN IS ADOPTED BY
ORDINANCE, OR UNTIL MARCH 1, 2008, WHICHEVER SHALL OCCUR FIRST.
WHEREAS, Resolution No. 16-07, Draft 2, duly adopted by the County Council,
temporazily delayed Council action on rezoning applications in the districts of North and South
Kona to allow time for the North and South Kona Community Development Plan process to be
completed; and
WHEREAS, Resolution No. 16-07, Draft 2, provided that the temporary delay would
expire upon adoption of the North and South Kona Community Development Plan by ordinance,
or September 1, 2007, whichever would occur first; and
WHEREAS, the North and South Kona Community Development Plan process is still
ongoing and an extension of time is necessary to allow for completion of this important
community-based process; and
WHEREAS, Resolution No. 16-07, Draft 2, included a provision which allows for
extensions of time in increments of not more than six months each; and
WHEREAS, this resolution proposes a single amendment to Resolution No. 16-07, Drafr
2, which is to provide asix-month extension of time that would extend the temporazy delay of
Council action on rezoning applications in the Districts of North and South Kona until the North
and South Kona Community Development Plan is adopted by ordinance, or until March 1, 2008;
now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
Resolution No. 16-07, Draft 2 is hereby amended to temporazily delay Council action on
rezoning applications in the Districts of North and South Kona until the North and South Kona
Community Development Plan is adopted by ordinance, or until March 1, 2008, whichever shall
occur first; and
BE IT FURTHER RESOLVED that all other provisions of Resolution No. 16-07, Draft
2, shall remain in full force and effect; and
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to the North and South Kona Community Development Plan Steering Committee,
Mayor Harry Kim, the County Planning Department, the Planning Commission, the Department
of Public Works and the Department of Finance.
