HomeMy WebLinkAboutRES 329 Draft 01 2006-2008 vvwy f~„`V ....1,~0 COUNTY OF HAWAII STATE OF HAWAII ~II Of ~Mf~' RESOLUTION NO. 329 0'7 A RESOLUTION REQUESTING THE DIRECTOR OF THE DEPARTMENT OF PUBLIC WORKS TO CONSISTENTLY ENFORCE THE REGULATIONS WITHIN CHAPTER 3, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO SIGNS. WHEREAS, the purpose of chapter 3 of the Hawaii County Code 1983 (2005 Edition, as amended), hereinafter "the Code", relating to signs, is to protect the natural beauty of Hawaii Island; ensure public safety, health and welfare; give fair and equal opportunity to all; reduce visual clutter; and encourage and promote the visitor industry; and WHEREAS, there has been an increase in the number of illegal signs as defined by section 3-7(a) (Signs prohibited in all districts) of the Code; and WHEREAS, this proliferation of illegal signs, including but not limited to sandwich boazds and banners, has created a substantial increase in the number of complaints from residents and visitors; and WHEREAS, section 3-1(b) of the Code provides for the fair establishment and consistent enforcement of the aforementioned sign regulations; and WHEREAS, section 3-37(a) of the Code states the director of the department of public works, or a designated assistant, shall enforce the regulations within chapter 3 of the Code; and WHEREAS, to ensure compliance with section 3-7(a), of the Code (Signs prohibited in all districts), enforcement pursuant to section 3-37 of the Code (Enforcement), must be increased; now therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the director of the department of public works, or a designated assistant, consistently enforce any and all violations of section 3-7(a) of the Code and that fines for violations be aggressively pursued in accordance with section 3-38(c), of the Code (Administrative enforcement); and BE IT FURTHER RESOLVED, that this Council recognizes and supports the ongoing efforts of the department of public works and will strongly consider the appropriation of additional funding, if required, to carry out a more aggressive campaign to enforce the regulations within chapter 3 of the Code; and ~E IT FINALLY i2ESOLVED that the County Clerk shall transmit copies of this resolution to the mayor of the County of Hawaii and the director of the department of public works.
