which Reclassified Lands from Agricultural - 5 Acre (A-Sa) to Single Family
Residential - 10,000 Squaze Feet (RS-10) at Kalaoa 41h, North Kona, Hawaii,
Covered by Tax Map Key 7-3-028:082 - 102 (Formerly 7-3-010:037)]

Attached is Bill 164, Draft 2 that reflects an amendment to Bill 164, outlined in Communication
No. 633.1, and duly approved at the September 5, 2007 meeting of the Committee on Planning.
Bill 164, Draft 2 amends Condition "K" and Condition "O" (old Condition "N"), as follows:
1. "K. To ensure that the goals and policies of the Housing Element of the
General Plan aze implemented, the applicant shall secure the concurrence of the
Office of Housing and Community Development that the applicant's affordable
housing requirements, if any, have been mutually aereed prior to Final
