No. 563Bi11 No. 137 PLACE: Councilroom Ben Franklin Building 333 Kilauea Avenue, 2nd Floor Hilo, Hawaii TIME: 1:30 p.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 137, reports as follows: Bill No. 137, transmitted via Communication No. 563 from Mayor Harry Kim, dated July 23, 2007, presents a Change of Zone Request by CYNTHIA THOMAS at Waiakea, South Hilo, Hawaii, TMK: Z-2-036:090. Bill No. 137 seeks to amend Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code 1983 (2005 Edition), by changing the District Classification from Single Family Residential - 10,000 Square Feet (RS-10) to Industrial- Commercial Mixed - 20,000 Squaze Feet (MCX-20) at Waiakea, South Hilo, Hawaii. Communication No. 563 reports that the Hawaii County Planning Commission, as required by Chapter 4, Sec. 6-4.3(C), Hawaii County Charter, considered the above request on July 6, 2007. The Commission concurred with the Planning Director's reasons for recommending a favorable consideration of this matter. Communication No. 563 transmits the following findings and recommendations: 1. The subject property is located on the northwest corner of the Lanikaula Street and Hinano Street intersection, Waiakea Houselots 1~` Series, Waiakea, South Hilo, Hawaii. 2. Applicant is requesting a Change of Zone from Single-Family Residential 10,000 squaze feet (RS-10) to Industrial-Commercial Mixed 20,000 square feet (MCX-20) for a parcel of land consisting of approximately 22,500 square feet. 3. Applicant intends to construct a 6,250 square foot steel-framed building which will be used as a self storage business with an office. Applicant is proposing to relocate her current storage business known as A & A Storage Company located in Keaukaha to the new facility. 4. The estimated cost of project is $350,000. Access to the project site is proposed from Lanikaula Street, a County roadway with an approximate pavement width of 22-24 feet within a 50-foot right-of--way. 6. County water is available to the site. 7. Electricity and telephone services are available to the project site and County fire stations, police and emergency medical services are available to the property. 8. The Planning Director recommended favorably on this request based on the following: • The Change of Zone request will conform to the goals, policies and standards of the General Plan Economic and Land Use Elements. • The Land Use Pattern Allocation Guide (LUPAG) Map designates this area as Industrial, which designation includes uses such as manufacturing and processing, wholesaling, large storage and transportation facilities and light industrial uses. • Land uses in the immediate area are a mix of residential, commercial, and industrial uses. • The project site is located within Zone "X," an area determined to be outside the 500- year floodplain. • The Change of Zone request is not contrary to Chapter 205A, Hawaii Revised Statutes relating to Coastal Zone Management as the subject properties are located approximately two miles from the nearest shoreline and will not be impacted by coastal hazard and beach erosion. • No valued cultural, historical or natural resources exist on the property and there is no evidence of any traditional and customary Native Hawaiian rights being practiced on the site. The August 14, 2007 Committee on Planning meeting in West Hawaii was cancelled due to the threat of hurricane Flossie and rescheduled to August 21, 2007 at the Hilo Councilroom. At the August 21, 2007 Committee on Planning meeting, no statements from the public were presented. Applicant Cynthia Thomas was present and gave a brief statement of her proposed project. Ms. Thomas stated she operates a storage business in a location she has rented for the past 15 years and she intends to construct a new building on the subject property and relocate her business. Council Member Brenda Ford's concern was whether Condition H which states that development generated runoff is to be disposed of on site and not diverted to adjacent properties also meant that runoff could not be disposed of into the streets. Mr. Kelly Gomes, Department of Public Works, stated that based on past practice, drainage and development runoff does runoff into the street and that in the existing Chapter 10 of the grading ordinance, the street is a place for drainage. Council Member Higa stated he noticed the property was sold a few years back and his concern was that there were all sorts of things being stored on the lot and it was somewhat of an eye-sore. Ms. Thomas stated the boat has been moved and the remaining items will also be removed. Ms. PC Repor[ No. 41 Communication 563 Bill 137 Page 3 of 3 Thomas did make note of the fact that all of her adjacent neighbors were in favor of her application. Council Member Ikeda stated he owns a business approximately a block above applicant's property and is in support of her application because the area is turning commercial. Your Committee concurs with the Planning Commission and the Planning Director's favorable recommendation for approval of the Change of Zone request.
