Below is the procedure that needs to be followed under the Sunshine Law as well as some options fir tasks to assign to the task force to report back on, based upon the discussion on Resolution 295-07 held at the September 6, 2007 Council meeting. To comply with the Sunshine Law, this communication will be agendized as a discussion to consider the establishment of a task force to discuss implementation of Resolution 295-07 which was passed at the September 6 Council meeting. Procedure under HRS &92-2.5 (1) The task force must be created during an official meeting of the Council. (2) The task force can consist of 2-4 members of the Council. (3) The matter assigned to the task force has to be related to official business. (4) The scope of the investigation and of each member's authority must be defined at the meeting. C Comm: ~ ~ ' Ref. (6) Deliberation and decision-making by the full Council on the matter assigned to the task force cannot occur at the same meeting that the task force presents its findings and recommendations. It must occur at a subsequent meeting. If the above procedures are complied with, the task force can meet and discuss the issue(s) assigned to it without following the notice and comment requirements of the Sunshine Law. However, the information cannot be shazed with the other members of the Council before a duly noticed Council meeting is held and Council members other than those on the task force cannot attend any of the task force meetings. Options for Assigned Tasks (1) Scope of duties, e.g., tracking bills and reporting back to the Council; lobbying on behalf of the Council. (Note that in the past, tracking of bills for the Council has been done by the administration and by LRB.) (2) Time commitment: full-time; half-time; 30 hours per week; other. (3) Hiring process: procurement bid process; employee contract hire; who has final authority to hire. PH:Is
