RE: Bill No. 179 : An Ordinance Amending Section 25-8-33 (City of Hilo
Zone Map) By Changing the District Classification from Agricultural - 1 Acre
(A-la) to Multiple Family Residentia15,500 Square Feet (RM 5.5) Covered by
Tax Map Key 2-3-37:15.
This matter first came before the Council as Bill 139, Drafts 1 and 2. Pursuant to the
recommendation received from the Planning Commission, Department of Health requirements
and the discussion that ensued during the August 21, 2007 meeting of the Hawaii County
Council Planning Committee, the applicant, Malulani, Inc., is submitting the attached bill for an
ordinance, regarding its rezoning request. The applicant is seeking this Council's approval for a
maximum of 10 units, rather than the origina124 units, and will now provide two (2) parking
spaces per unit.

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Planning Committee to the full Council for immediate action. In reviewing this
matter, timely approval is crucial. It is therefore advantageous that approval is granted and the
matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Planning Committee
for placement on its future agenda.
