+tY os y,~ <br /> ~~L~ <br /> .,'Ei <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> r~ os x.~ <br /> RESOLUTION NO. 353 U7 <br /> RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL <br /> <br /> YEAR AND OF MORE THAN ONE FISCAL YEAR FOR ANIMAL CONTROL <br /> SERVICES <br /> WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other <br /> obligation requiring payment of funds from the appropriations of a later fiscal year or more than <br /> one fiscal year be approved by resolution; and <br /> WHEREAS, Hawaii Revised Statutes Chapters 46 and 143, and Chapter 4 of the Hawaii <br /> County Code 1983 (2005 Edition, as amended) authorize the County to regulate a variety of animal <br /> activities; and <br /> WHEREAS, Hawaii Revised Statutes Section 143-15 allows the County to contract with any <br /> society or organization formed for the prevention of cruelty to animals for the seizure and <br /> impounding of all unlicensed dogs and for the maintenance of a shelter or pound; and <br /> WHEREAS, Section 4-6 of the Hawaii County Code 1983 (2005 Edition, as amended) <br /> authorizes the County Council to appropriate funds for stray dogs, cats and small domesticated <br /> animals and for the assistance of societies to accomplish the related responsibilities which are <br /> delegated to the societies; and <br /> WHEREAS, the County wishes to contract with such an organization for animal control <br /> activities; and <br /> WHEREAS, the County finds that for economic and practical reasons, it is in the best <br /> interest of the County that the contract for animal control services covers more than one year; and <br /> WHEREAS, the County will issue a Request for Proposal seeking to contract with an <br /> organization to provide animal control services for a period up to June 30, 2012. <br /> <br />
