Home My WebLink AboutRES 359 Draft 01 2006-2008 ~Mtr or w 6i~ COUNTY OF HAWAII STATE OF HAWAII ~~Of ~M~' RESOLUTION NO. 3S9 U'7 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF DEFENSE, STATE CIVIL DEFENSE, PURSUANT TO HRS 46-7, FOR THE BUFFER ZONE PROTECTION PROGRAM WHEREAS, the State of Hawaii Department of Defense, State Civil Defense has received funds for FY2006 from the Department of Homeland Security, through the infrastructure Protection Program and the Homeland Security Appropriations Act to provide grant funding to the Buffer Zone Protection Program to protect and secure critical infrastructure and key resource sites; and WHEREAS, these funds, being granted to the Hawaii County Civil Defense Agency, are provided to enhance the County's response to incidents of terrorism, particularly those involving chemical, biological, radiological, nuclear, and explosive incidents and to enhance buffer zone planning and security enhancements for the Southern Cross Cabling Station located in Kona, Hawaii; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, the Memorandum of Agreement with the State Civil Defense, attached hereto and incorporated herein by reference as Exhibit "A", to enable the County of Hawaii to use these grant funds for Buffer Zone Protection Program. BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Finance Department, the Hawaii County Civil Defense Agency, and the State of Hawaii Department of Defense. Memorandum of Agreement For FY 2006 Department of Homeland Grant Program Program: Buffer Zone Protection Program SUBGRANTEE: Hawaii County Civil Defense Agency ARTICLE I -PROGRAM DESCRIPTION Funding assistance is provided to the County of Hawaii in the amount of $189,000.00 for the continued development of its Homeland Security Program, specifically related to Buffer Zone Protection planning and security enhancements. The FY 2006 Buffer Zone Protection Program (BZPP) grant program continues to provide planning, equipment, training, exercise, and management and administrative funding to prevent, protect, respond to and recover from incidents of terrorism, particularly those involving chemical, biological, radiological, nuclear and explosive (CBRNE) incidents. Specifically, these Buffer Zone funds are to enhance security with local emergency management, law enforcement and Southern Cross Cabling Station in Kona, Hawaii. ARTICLE II -AUTHORITIES Both State Civil Defense and Hawaii County Civil Defense shall follow the following guidance: FY 2006 Department of Homeland Security Appropriations Act DepartmentofHome/and Security Appropriation Actof2006Pub/icLaw109-90and Catalog of Federal Domestic Assistance 97.078. ARTICLE III -PERIOD OF PERFORMANCE The Period of Performance shall be nine months from the effective date of the grant award: October 1, 2006 to September 30, 2008. The County of Hawaii shall not incur costs or obligate funds for any purpose pertaining to the operation of the project, program, or activities beyond the expiration date of the period of performance. ARTICLE IV -AMOUNT AWARDED AND DISTRIBUTION This Memorandum of Agreement for the FY 2006 Buffer Zone Protection Program funds supports the objectives below: Expenditures of all grant funds must be allocated against the Implementation Strategy for Hawaii Homeland Security. Hawaii County Civil Defense Agency, along with law enforcement agencies and the facility manager of the Southern Cross Cabling Station are required to complete an initial Detailed Budget Worksheet and an Initial Strategy Implementation Plan identifying the use of the fund. All funds will be allocated against the Buffer Zone Protection Plan and the Vulnerability Reduction Plan. The Department of Homeland Security Infrastructure Protection Program and Grants and Training must approve changes to the Detailed Budget Worksheets and the Initial Strategy Implementation Plan prior to committing funds. EXHIBIT "A" The Detailed Budget Worksheet for this award may include the following categories used to develop the Vulnerability Reduction Plan for the Buffer Zone Protection Plan (Attachment 1): 1. Explosive Device Mitigation and Remediation Equipment 2. CBRNE Search and Rescue Equipment 3. Information Technology 4. Cyber Security Enhancement Equipment 5. Interoperable Communications Equipment 6. Detection Equipment 7. Power Equipment 8. Inspection and Screening Systems 9. Physical Security Enhancement Equipment 10. Terrorism Incident Prevention Equipment 11. Medical Supplies and Limited Types of Pharmaceuticals The grant funds are not allowed to hire sworn public safety officers for the purposes of fulfilling traditional public safety duties or to supplant traditional public safety positions and responsibilities. Hawaii County Civil Defense Agency is permitted to sub grant funds to the Hawaii County Police Department for program execution. ARTICLE V -COST-SHARE/MATCH There is no cost-share or match required for these grant funds. If costs exceed the maximum amount of funding, the County of Hawaii shall pay the costs in excess of the approved budget. ARTICLE VI -MAINTENANCE OF EFFORT/SUPPLANTING OF FUND The purpose of these funds is to support the County of Hawaii to improve or enhance the county's ability to prevent, protect, respond to, and recover from threats and acts of terrorism program activities that relate to the security enhancement related the Buffer Zone Protection Planning specifically designated for the Southern Cro55 Cable Landing. Specifically, these funds aze to focus security enhancements to activities related to incidents to protect and prevent terrorist incidents involving CBRNE. The funds shall be used to supplement and shall not be used to supplant county funds dedicated to this effort. DHS, through the Federal Emergency Management Agency, National Preparedness Directorate requires the entire project consider the environmental impacts under the National Environmental Policy Act (NEPA). The NEPA form submitted with the application (Attachment 2) is for further review and modifications as necessary based on the scope of the project. Prior to expending funds to support the Vulnerability Reduction Plan this form must be re-filed with DHS. ARTICLE VII -ADMINISTRATIVE COST RESTRICTION The Buffer Zone Protection Program grant funds can not be transferred to other homeland security grant programs. ARTICLE VIII -REQUEST FOR ADVANCE The method of payment will be by reimbursement or a cash advance method. Prior to receipt of the award, Hawaii County Civil Defense, Hawaii Police Department and representatives from Southern Cross are required to prepare an Operational Expenditure Plan that identifies when funds will be committed. State Civil Defense will advance funds based on the expenditure plan. Advance payment will be made to the county using the Cash Advance Form is submitted to State Civil Defense. State Civil Defense will coordinate the Operational Expenditure Plan on a quarterly basis with the Hawaii County Civil Defense Agency and make adjustments in the cash advance based on expenditures and cash flow. The county may utilize the reimbursement method of payment. Appropriate documentation for payment will include a copy of the purchase order/contract and vendor invoice certified "purchases/services received" submitted to State Civil Defense. State Civil Defense will process payment directly with Department of Defense Fiscal Office. Hawaii County Civil Defense Agency or if sub granted to the Department of Transportation Services, the sub grantee may keep interest amounts up to $100.00 per year of administrative expenses for all Federal grants combined. Interest must be placed in an interest-bearing account and are subjected to rules outlined in the Uniform Rule 28 CFR 66, Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Government. ARTICLE IX -FINANCIAL REPORTS FINANCIAL STATUS REPORT: State Civil Defense shall submit financial reports (Financial State Report (SF-269) to the Office of the Comptroller within 30 days after the end of each quarter. Reports are due February 15, May 15, August 15, and November 15. Final financial reports are due 90 days after the close of the grant. Hawaii County Civil Defense will be required to provide a status report to State Civil Defense on a quarterly basis so as to allow compliance with the DHS Grants and Training reporting requirements. REPORT SUBMISSION: The County of Hawaii should submit quarterly reports to State Civil Defense, Attn: Homeland Security Officer, Anti-Terrorism Planner by the 5th day of the month following the ending of each quarter.
