policy changes for requiring an Environmental Assessment (HRS 343-5) based on
the new information received from The Sierra Club vs. The Department of
Transportation ofthe State ofHawai `i (CIV. No. OS-1-0114, (Appeal from the 2"a
Circuit Court -Maui).

I would like to schedule a discussion by the Council Committee on the Planning Department's
recent policy changes for requiring an Environmental Assessment (HRS 343-5) in view of the
Supreme Court of the State of Hawaii decision in The Sierra Club vs. The Department of
Transportation ofthe State ofHawai'i (CIV. No. OS-1-0114, (Appeal from the 2"a Circuit Court -
Maui). If there are any other cases, HRS statutes, or other information applicable to the
discussion, it may also be addressed during this discussion.
I anticipate about one hour for the discussion that may include Corporation Counsel. Please
agendize this discussion for the Planning Committee on November 6, 2007.
