HomeMy WebLinkAboutRES 384 Draft 01 2006-2008OFFICE INFORMATION ONLY Meeting: November 2U. 2UU7 -Council Meeting, (24`x' Session) Action: Close File - November 2U. 2UU7 Re: RESOLt1TION X84-07/C'-7~4/PVv'1RC-40 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 384 0'7 RESOLUTION AUTHORIZING THE ABANDONMENT AND DISPOSITION OF AN OLD GOVERNMENT ROAD SITUATE AT NANUE, DISTRICT OF NORTH HILO, COUNTY AND STATE OF HAWAII. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, government survey maps show the existence of an old government road, containing an azea of 8,509 squaze feet, that bisects Tax Map Key: (3)3-2-001:019 (see attached map), which is owned by Gregory Lee Dilworth and Machi Fukuyama Dilworth; and WHEREAS, this old government road is not utilized as a roadway; and WHEREAS, all roadways, once established, continue until vacated, closed, abandoned, or discontinued by resolution of the Council; and WHEREAS, the County of Hawaii finds that this old government road is no longer required as a vehicular transportation corridor; and WHEREAS, the County of Hawaii finds that this old government road is economically and physically unsuitable or undersirable for development or utilization as a sepazate unit by reason of its location, size and shape, and by definition is a remnant in accordance with Section 2-110, Hawaii County Code; and WHEREAS, the properties abutting this old government road are: Tax Map Key: (3)3-2-001:019 Gregory Lee Dilworth Machi Fukuyama Dilworth Tax Map Key: (3)3-2-001:020 Gretchen Goo Bruce A. MacDuckston Tax Map Key: (3)3-2-001:025 Steven L. Wolf Maria J. Wolf WHEREAS, the Dilworths, through their attorney Michael W. Moore, have expressed a desire to acquire the abovementioned old government road; and WHEREAS, Gretchen Goo and Bruce A. MacDuckston were notified of the pending sale but have not responded; and WHEREAS, the Wolfs' were contacted and have expressed their objection to the disposition of the old government road; and WHEREAS, Section 2-111, Hawaii County Code, provides that the Council may direct the Finance Director to dispose of real property in fee simple; and WHEREAS, Section 2-118, Hawaii County Code, provides that remnants or portions thereof may be disposed of without recourse to public auction and shall be first offered to the abutting landowners; and WHEREAS, an appraisal was done of the property in Januazy 2007, which established a fair market value of $3,125. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, the aforementioned old government road is declared to be abandoned and otherwise a discontinued right-of--way which is physically and economically unsuitable or undesirable for development or utilization as a separate unit by reason of its location, size and shape and by definition is a remnant in accordance with Section 2-I 10, Hawaii County Code. BE IT FURTHER RESOLVED that the Finance Director is authorized to sell the aforementioned remnant without recourse to public auction in a manner consistent with Section 2-118, Hawaii County Code. BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Mayor Harry Kim; (2) Finance Director William Takaba; (3) Bruce C. McClure, Director of Public Works; (4) Assistant Corporation Counsel Gerald Takase; (5) Gregory Lee Dilworth and Machi Fukuyama Dilworth, c/o Michael W. Moore, 85 W. Lanikaula Street, Hilo, Hawaii 96720; (6) Gretchen Goo, P.O. Box 104, Ninole, Hawaii 96773; (7) Bruce A. MacDuckston, 2033 Ralston Avenue #105, Belmont, California 94002; and (8) Steven L. Wolf and Maria J. Wolf, P.O. Box 13, Ninole, Hawaii 96773. Dated at Hawaii, this day of 2007.
