RESOLUTION NO. 394 0'7
RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO
AN AGREEMENT WITH THE OFFICE OF THE PUBLIC DEFENDER, PURSUANT
TO HRS 46-7, FOR THEIR JOINT PARTICIPATION IN THE COMMUNITY
ORIENTED POLICING SERVICES (COPS) METHAMPHETAMINE INITIATIVE
WHEREAS, the Office of the Prosecuting Attorney has been awarded a Community
Oriented Policing Services (COPS) Methamphetamine Initiative Grant by the U.S. Department of
Justice, Office of Community Oriented Policing Services; and
WHEREAS, the Office of the Prosecuting Attorney had applied for the funds to improve the
Big Island Drug Court's (BIDC) efforts to more effectively intervene and engage the
methamphetamine offender in a timely manner; and
WHEREAS, one of the objectives of the initiative, relating to the Office of the Public
Defender, is the funding of a paralegal position to assist in identifying potential BIDC clients,
processing of admission requests, developing necessary administrative and clerical tracking
systems of BIDC applicants and participants and assisting BIDC assigned deputy public defenders
with technical and legal issues arising out of the legal representation of clients involved in the
BIDC; and
WHEREAS, through the collaboration of different agencies by providing timely and effective
treatment for drug offenders with appropriate sanctions and incentives, the meth (substance
abuse) problem can be addressed properly; and
WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments
obtain the consent of the council to enter into agreements with the federal or state governments
respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and
receive any funds or other assistance in connection with projects being or to be undertaken
pursuant to those powers.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the Office of the Mayor is authorized to enter into a Contract Agreement with the
Office of the Public Defender.
BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign
the above-referenced agreement and any related documents on behalf of the Office of the Mayor
and the County of Hawaii pursuant to the Hawaii County Charter.
BE fT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit
copies of this resolution to the Office of the Mayor, Office of the Prosecuting Attorney, and the
Finance Department.
