Dear Chair Hoffmann and Members of the County Council:
SUBJECT: BILL 79, RELATING TO OFF-STREET PARKING AND LOADING
There is a timing issue with respect to this bill that could be handled by a slight amendment, so
that it will affect only plan approval applications received after the effective date of the bill. The
Planning Department checks parking during plan approval review. If the bill is signed, the
Planning Department will have some plan approval applications still pending for which the
review had not been completed. It would be quite unfair to reject plans that complied with the
Zoning Code when they were received, but which are out of compliance when they are actually
checked for parking because of a change in the law.
This can be done by a simple amendment to sec. 6 of Bill 79, so that it would read:
"SECTION 6. This ordinance shall take effect upon its approval[.] and be applied to applications
for plan approval received after its effective date."
We think that this result could be achieved by administrative decision, without amending the bill,
but out of caution, we request that the council so amend the bill at first reading. I apologize for
this late request for an amendment.
