RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII, HAWAI`1 TOURISM AUTHORITY, PURSUANT TO HRS 46-7, TO EXTEND THE WAIPI`O PARK RANGER PILOT PROGRAM WHEREAS, the State of Hawaii, Hawaii Tourism Authority has authorized funding, through its Natural Resources Program, to the Department of Research and Development to extend the Waipi'o Park Ranger Pilot Program; and WHEREAS, with the Waipi'o Valley being a very popular tourist destination, the County will be using the grant funds to extend an educational program at the county park at the Waipi`o Scenic Overlook to monitor commercial and visitor activity, report any illegal activity to law enforcement, serve as educational resources for the public, enhance the visitor experience, and protect the environment; and WHEREAS, destructive and illegal activities in the valley and at the scenic overlook have increased over the past few years and concerns have been raised by community members, park staff, and landowners that these activities are damaging the environment, creating safety hazards, tarnishing the visitor experience, and offending the host culture; and WHEREAS, the program strives to ensure the safety of all visitors and residents at Waipi`o Valley, enhance the visitor experience by providing education about the area's natural and cultural histories and resources; enhance the reputation of legitimate businesses in the tourism industry; and enhance the appearance of the County Park located at the Waipi`o Scenic Overlook; and WHEREAS, recognizing the value of community-based efforts, the County of Hawaii has partnered with the community by entering into a contract with Friends of the Future, anon-profit organization based in Waimea and deeply involved in Waipi'o Valley since 1991; and WHEREAS, Friends of the Future is implementing the program with the support, advisement, and involvement of county government, state agencies, and community-based organizations, to raise visitors' awareness of the Valley's history and cultural significance; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, a Contract for Goods and Services with the State of Hawaii, Hawaii Tourism Authority, to enable the County of Hawaii to extend the Waipi'o Park Ranger Pilot Program as described in the Scope of Services, attached hereto and incorporated herein by reference as Exhibit "A". BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Finance and Research and Development Departments. Waipio Ranger Pllot Program Year Two -County of HawaG Dept. of Research and Development Contract No. BT-07-27 ATTACHMENT 1 SCOPE OF SERVICES The CONTRACTOR shall perform and provide, in a satisfactory and proper manner as determined by the STATE, all goods and services described below and in the CONTRACTOR's accepted proposal dated September 13, 2006 ("PROPOSAL"), attached hereto and incorporated herein as Exhibit A, including the following: 1. The CONTRACTOR shall operate the Waipio Ranger Pilot Program to contract rangers to staff the county park at the Waipio Scenic Overlook to monitor commercial and visitor activity, report any illegal activity to law enforcement, serve as educational resources for the public, enhance the visitor experience, and protect the environment; and as further described in the PROPOSAL (hereinafter referred to as the "PROJECT"). 2. STATE funds shall be used for expenses related to the PROJECT within the context of the CONTRACTOR's budget, attached hereto and incorporated herein as Exhibit B. Any change to this budget shall require prior written approval by the STATE. ~ 3. The CONTRACTOR shall use its best efforts to perform the goals and objectives stated in its PROPOSAL. 4. The HAWAII TOURISM AUTHORITY shall be credited as a sponsor on all advertising and promotional materials. The CONTRACTOR shall consult with the STATE's marketing contractors to coordinate mazketing efforts as appropriate including, to the extent possible, listing any public events on web sites and calendars of events, and participating in the "Hawai`i Knowledge Bank" program. If applicable, the CONTRACTOR shall submit a final schedule and copies of all advertising and promotional activities with the final written report to the STATE. 5. Prior to the release of STATE funds, the CONTRACTOR shall submit proof of matching funds of at least 100% of the award amount of SIXTY THOUSAND AND NO/100 DOLLARS ($60,000.00). Cash contributions shall be demonstrated in the fomt of receipts of deposit or binding letters of commitment. The CONTRACTOR shall prepaze and maintain financial records which sufficiently and properly reflect all income and other sources of funds, and all direct andvnduect expenditures of any nature related to the CONTRACTOR'S performance of this Contract. These records shall be subject to any inspection, review, or audit by the STATE. 7. The CONTRACTOR shall submit a financial report to the STATE upon completion of the PROJECT and prior to the completion of the contract period. The financial report shall include, but not be limited to, a certification by the CONTRACTOR that all financial statements represented in the report aze accurate and that STATE funds allocated under this Contract have been expended in accordance with the provisions set forth in this Contract, including the budget made a pazt of this Contract. The report shall also specify the expenses for which STATE funds were utilized. All STATE funds not expended in accordance with the provisions set forth in this Contract and the budget shall be returned to the STATE. 8. The CONTRACTOR shall complete and submit a final written report to the STATE prior to the completion of the contract period and final payment by the STATE by using the "Hawaii Tourism Authority Natural Resources Program Final Report Form," attached hereto and incorporated herein as Exhibit C. 9. The CONTRACTOR shall provide any progress report requested by the STATE describing the status of all work required to be completed under this Contract and as maybe required in Attachment 2. The CONTRACTOR shall furnish any additional reports or information that the STATE may, from time to time, require or request.
