Inter-Governmental Agreement
between the
State of Hawaii Wireless Enhanced 911 Board
and the
Mayor of the County of Hawaii
Purpose and Scone
This Inter-Governmental Agreement (IGA) is intended to establish a cooperative
framework for the Public Safety Answering Points (PSAPs) located in the County of
Hawaii to recover their costs from the Wireless Enhanced 911 (WE911) Fund for the
planning, testing, and deployment of Phase I and Phase II wireless enhanced 911 service.
Authority
Hawaii Revised Statutes (HRS), § 138-2, established the Wireless Enhanced 911
(WE911) Boazd.
HRS § 138-3 established the WE911 Fund, a special fund outside of the state treasury to
be administered by the Boazd; the fund shall be expended exclusively by the WE911
Board for the purposes of ensuring adequate cost recovery for the deployment of Phase I
and Phase II WE911 service, and for expenses of administering the fund.
HRS § 138-5 authorized every PSAP in the State to be eligible to seek reimbursement
~ from the WE911 Fund to pay for the reasonable costs to lease, purchase, or maintain all
necessary equipment, including computer hazdwaze, software and database provisioning,
as required by the PSAP to provide technical functionality for the WE911 service
pursuant to the Federal Communications Commission (FCC) order 94-102.
Proc ores
1. For costs which the PSAPs aze seeking reimbursement, prior to procuring the
services, hazdwaze and software for the planning, testing, and deployment of Phase I
and Phase II WE9t I service, shall secure the approval of the WE911 Board.
2. The WE911 Boazd, upon completion of its review of the PSAP's requests, shall
inform the PSAPs of the WE911 Board's approval or disapproval of the requests.
3. The PSAPs, upon receipt of the WE911 Boazd's approval, may proceed with the
procurement of the required services, hazdwaze or softwaze, and shall follow all
applicable procurement laws, rules, and policies.
4. The PSAPs, upon receipt of the services, hazdwaze or software, shall make
appropriate payments to the vendors.
5. The PSAPs, after making payments to the vendors, shall submit copies of the invoices
and checks to the WE911 Boazd for reimbursement of the payments made for such
services, hardware and software.
6. The WE911 Boazd, upon receipt and review of the PSAP's invoices and checks for
which reimbursement is being sought, that were previously approved, shall transmit
the appropriate funds to the Director of Finance for the County of Hawaii (Director).
Amendments and Effective Date
This IGA may be altered, amended or modified only by the mutual written agreement of
the WE911 Boazd and the Mayor. This IGA contains all terms and conditions,
stipulations and agreements agreed upon by the parties. This IGA supersedes any other
agreement, promise and negotiation between the parties, and no party shall be bound by
any inducement, statement, representation promise or agreement not contained herein.
The IGA is effective upon its execution by the parties, and shall remain in effect until
terminated, in writing, by the WE911 Board or the Mayor.
