AN ORDINANCE TO DIVIDE LELEIWI BEACH PARK INTO TWO NEW BEACH PARKS,
NAME THESE TWO NEW PARKS PURSUANT TO CHAPTER 15, ARTICLE 8, AND TO
RETAIN CURRENT PROVISIONS FOR CONSUMPTION OF INTOXICATING LIQUORS
PURSUANT TO CHAPTER 14, ARTICLE 1 OF THE HAWAII COUNTY CODE 1983 (2005
EDITION, AS AMENDED).
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`L
SECTION 1. Purpose. The purpose of this ordinance is to divide Leleiwi Beach Park
into two distinct beach parks. Leleiwi Beach Park encompasses two distinct parcels with
independent Tax Map Key numbers. These distinct parcels would be named "Wai`olena Beach
Park" and "Wai`uli Beach Park" pursuant to chapter 15, article 8, of the Hawaii County Code,
which establishes guidelines for the naming of such facilities. Section 15-67(a)(2)(A) provides
that any "open area" County faoility shall, inter alia, be named for its neighborhood, community,
region, district or other identifying geographical location. The purpose for distinguishing and
renaming the beach parks is to give each park its proper historical name according to their
geographical sites. The word "Wai`olena" refers to the light water of that certain open area
County park identified by TMK (3) 2-1-18-26. The word "Wai`uli" refers to the dark water of
that certain open area County park identified by TMK (3) 2-1-19-9. The subject parcel is an
open area park located in the Keaukaha area of South Hilo. The site is located at the end of
Kalaniana`ole Avenue. Accordingly, chapter 14, article 1 of the Hawaii County Code is also
amended to retain current provisions for Leleiwi Beach Park relating to the consumption of
intoxicating liquors.
SECTION 2. Notwithstanding any other law to the contrary, that certain open area
County park identified by TMK (3) 2-1-18-26 is hereby named "Wai`olena Beach Park" and
TMK (3) 2-1-19-9 is hereby named "Wai`uli Beach Park".
SECTION 3. Chapter 14, article 1, section 14-1(a)(6)(AA), Hawaii County Code 1983
(2005 Edition, as amended), relating to intoxicating liquors prohibited in certain public places, is
amended to read as follows:
"(AA) [r : n°^~w o...a.~ Wai`olena and Wai`uli Beach Parks, portion located between the
pavilions and the west end of the seawall beginning at a point four-tenths of a mile west
of Leleiwi Street and extending three hundred twelve feet in the westerly direction."
SECTION 4. Chapter 14, article 1, section 14-2.2(a)(1)(E), Hawaii County Code 1983
(2005 Edition, as amended), relating to intoxicating liquors allowed between the hours of 10:00
a.m. and 10:00 p.m., is amended to read as follows:
"(E) [T Wai`olena and Wai`uli Beach Parks, except a portion located
between the pavilions and the west end of the seawall beginning at a point four-tenths of
a mile west of Leleiwi Street and extending three hundred twelve feet in the westerly
direction; '
SECTION 5. Chapter 15, article 8, section 15-68.1, Hawaii County Code 1983 (2005
Edition, as amended), Hilo/Hamalcua facility schedule, is amended to read as follows (Note:
underlining of Hilo/Hamakua is not meant to indicate a ramseyered change to the current code.):

SECTION 6. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed and stricken material and
underscoring need not be included.
SECTION 7. In the event that any portion of this ordinance is declared invalid, such
invalidity shall not affect the other parts of this ordinance.
SECTION 8. This ordinance shall take effect upon its approval.
