A RESOLUTION REQUESTING THE DIRECTOR OF PUBLIC WORKS TO WORK WITH
THE PLANNING DEPARTMENT, THE PUBLIC, AND THE HAWAII COUNTY COUNCIL
TO UPDATE AND REVISE CHAPTER 3 OF THE HAWAII COUNTY CODE 1983 (2005
EDITION, AS AMENDED), RELATING TO SIGNS.
WHEREAS, chapter 3, Hawaii County Code 1983 (2005 Edition, as amended), hereinafter
"the sign code", is outdated requiring comprehensive revision; and
WHEREAS, the Hawaii County Council is requesting that the Department of Public Works
delay enforcing sign code infractions that are not in any public right-of--way and that do not impede
traffic or do not pose a traffic hazard (sandwich boards that impair traffic or line of sight or are located
improperly in a public right-of-way should be cited); and
WHEREAS, Council Members have the duty to educate and inform the public on the
provisions of the sign code; and
WHEREAS, the responsibility of creating effective and fair policy is vested with the Hawaii
County Council and therefore the Department of Public Works has been unfairly tasked to enforce a
sign code that is inconsistent and outdated; and
WHEREAS, the Mayor will ask his departments to review the sign code and ask the
Department of Public Works to work with the Planning Department, the public, and the Hawaii
County Council to craft an ordinance that is more in tune with today's needs; and
WHEREAS, the Mayor of the County of Hawaii agrees, understands, and supports the
purpose of this resolution; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Director of the Department of Public Works, or a designated assistant, will work with all the Planning
Department, public, and the Hawaii County Council to review and overhaul the sign code; and
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution
to the Honorable Harry Kim, Mayor; the Director of Public Works, Bruce McClure; Planning Director,
Chris Yuen; Executive Director, Hilo Downtown Improvement Association, Lalea Sam Pulu`ole;
President, Kanoelehua Industrial Area Association, Allan Onishi; and President, Hawaii Leeward
Planning Conference, Jacqui Hoover.
